- The Centers for Disease Control and Prevention (CDC) intends to issue sole source firm-fixed price purchase order for a maintenance agreement for the following item: Line Item 0001 MoFlo Cytometer, Bracket 2, SN 1332. The agreement will provide full service support, unlimited emergency service with no additional charges for on-site labor, travel time, or travel expenses during Beckman Coulter’s normal business hours, replacement parts, labor, travel, telephone coverage, and one preventive maintenance visit per year. Repair and maintenance must be supplied directly by Beckman Coulter to avoid invalidation of equipment warranties or service agreement coverages. Beckman Coulter is the sole supplier of authorized parts and service for all equipment manufactured by Beckman Coulter. Delivery to: Attn: Roselyn Hochbein, Centers for Disease Control and Prevention, 3150 Rampart Road/Foothills Campus, Fort Collins, Colorado. The maintenance agreement will be for a period of one (1) year. Note 22 applies herein. The statutory authority permitting other-than-full-and-open competition is 41 U.S.C., 253(c) (1): FAR 6.302-1. Only one responsible source and no other services will satisfy agency requirements. Interested persons may identify their interest and capability to respond to the requirement. This notice is not a request for competitive proposals. A determination by the Government not to compete this proposed contract will be based on responses to this notice and is solely within the discretion of the Government. Information received will be considered solely for informational purposes. This procurement is not set-aside for small business. The proposed contract action is for commercial items which the Government intends to solicit and negotiate with only one source under authority of FAR subpart 27.4. Interested persons may identify their interest and capability to respond to the requirement. THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN SUBPART 12.6, AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE SOLICITATION; A SEPERATE WRITTEN SOLICITATION WILL NOT BE ISSUED. QUOTES ARE BEING REQUESTED. The following FAR Clauses are hereby added to this clause: 52.247-35 F.O.B. Destination; The clause at 52.212-5 - Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items applies to this acquisition. The following clauses listed in paragraph (b) of 52.212-5 apply to this acquisition: (1), (5), (7), (14), (15), (16), (17), (18), (22), (24), (29) and (30). 52.213-3 must be attached to bid.
