Description
1. The amendment states "unforeseen circumstances". Can you clarify what these circumstances are at this time? Government answer: The acquisition was under- estimated. Because of lack of resources the government had to reduce our requirements. 2. Attachment 4 Special Provisions for Intellectual Property Rights allows the offeror to state a purchase quantity that would allow the Government to obtain GPLR. Attachment 4 also affects the offeror's GPLR rating for Volume III per the evaluation criteria of the solicitation. Since the maximum quantity has been dramatically reduced, this could affect the timeframe in which the Government would be able to purchase enough XM205s to obtain GPLR, which in turn could negatively affect an offeror's rating under Volume III GPLR: a. Does the Government intend to change its evaluated rating for an offeror under Volume III in relation to the reduced quantity that can be purchased? Government answer: Government answer: No b. Or, will the Government change its evaluation criteria under Volume III? Government answer: Government answer: No c. If not, will the Government allow an offeror to revise any other portions of its proposal besides the pricing section. Government answer: Yes the closing date has been extended to 15 August 2008. Please reference FAR 15.208. 3. Amendment 0004 only allows price changes for the Ordering Period I - V unit prices. Can an offeror revise any other pricing at this time, e.g. TDP, FAT, or base quantity? Government answer: Yes the closing date has been extended to 15 August 2008. Please reference FAR 15.208 4. The original solicitation required the offeror to hold pricing for 60 days which would expire around 12 August. Is the Government asking for another 60 days beginning 15 August? Government answer: Yes, the 60 days would restart on 15 August 2008. If your proposal lists a hard date, please revise your proposal. 5. Please note that in Company XYZs proposal it states, "As part of Company XYZ's submission of the attached proposal, it is clearly understood that unless other arrangements are agreed to in writing, the USG shall return the proposal (including hardware, technical data, and video materials) in its entirety to Company XYZ within 60 days of submittal, regardless of whether or not an award has been made." Company XYZ here by requests the Government provide a written notification stating the additional length of time, if any, that Company XYZ's proposal and hardware would be required to continue evaluation purposes. Government answer: A letter can be sent for an extension if Company XYZ proposal does not change. However, if Company XYZ submits a revised proposal, the 60 days would restart. Note: Company XYZ used in this question is fictitious..
