- Title: Purchase Order for the Analysis of Petroleum Exports (APEX) database Description: The U.S. Department of Energy (DOE) intends to solicit a proposal and negotiate a sole source contract with Lloyd?s Marine Intelligence Unit (LMIU) for the use of the Analysis of Petroleum Exports (APEX) database for the Energy Information Administration (EIA). The proposed contract will provide oil export and tanker movement information to support the contingency and international oil markets and analyses which are integral to the mission of EIA?s Energy Markets and Contingency Information Division. The statutory authority for permitting other than full and open competition for this contract is Section 303[c][1] of the Federal Property and Administrative Services Act of 1949, as amended by the Competition in Contracting Act, 41 USC 253[c][1]. The applicable authority is 10 U.S.C.2304 (d) (B), as implemented by FAR 6.302-1[a] [2] [ii] [B], which authorizes other than full and open competition when there is only one responsible source and no other supplies or services that will satisfy agency requirements; and when it is likely that an award to any other source may result in unacceptable delays in fulfilling the agency?s requirements. No other firm in the world possesses the ability to provide real time global seaborne oil trade a nd tanker movement data. As such, this unique ability to provide data on real time global seaborne oil exports and tanker movements necessitates the award of a contract to LMIU. Interested parties may submit rationale as to why they should be considered within fifteen (15) days of this notice via email at Michael.Thomey@hq.doe.gov. A determination by the Government not to proceed with this proposed contract based upon responses to this notice is solely within the discretion of the Government. The North American Industry Classification System (NAIC) Code for this requirement is 541990. The period of performance is twelve months plus a 12 month option period.
