Description

DISA/DITCO, intends to issue a sole source contract to DTS Software Inc., 2913 Wake Forest Road, Raleigh, NC 27609-7841. This acquisition is for renewal of DTS Software Maintenance. This software and maintenance renewal is proprietary and protected by copyright laws. No third party maintenance is authorized. Period of performance is 1 Oct 08 through 30 Sep 09. The statutory authority for other than full and open competition is 10 USC 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements. This acquisition will be a small business set-aside. Companies who can provide the above listed software maintenance renewal must complete the solicitation, HC1028-08-T-0123 available at http://www.fbo.gov/. The resultant contract will be a firm fixed price purchase order. The NAICS code is 511210 for this procurement. Small Business Set-Aside/SOLE SOURCE JUSTIFICATION FOR ACTIONS LESS THAN $100,000.00: The Vendor owns all proprietary rights to the software's source code and is the only responsible sole source for maintenance. No other source can provide maintenance upgrades (e.g., versions, and releases), correct pro blems (e.g., patches, fixdocs, Program Temporary Fix (PTF), and keys/pqsswords (by CPU model, serial number, or time period) authorizing operation of the software.
