- The Department of Health and Human Services, Program Support Center, Division of Acquisition Management on behalf of the Office of the Secretary (OS), Office of the Inspector General (OIG), Office of Audit Services (OAS) intends to negotiate on a sole source basis for one base year, and four option years with Dr. Alan H. Kvanli, 3837 Hunters Trail, Carrollton, TX 75007 to continue assisting the OAS in statistical auditing and methodolgies. The statutory authority for other than full and open competition is 41U.S.C.253(c) (1), only one responsible source and no other supplies or services will satisfy agency requirements. Since February 8, 1988, Dr. Kvanli has provided the Office of Audit Services (OAS) with statistical advice and assistance including development of a new multistage methodology based on the work of Rao, Hartley, and Cochran (RHC). Dr. Kvanli wrote computer programs to select the sample items using the RHC methodology and to appraise the audit data. This methodology was used in multistage audits, including the CMS financial statement audit, with significant reduction in audit resources. Dr. Kvanli is thoroughly knowledgeable of all methodologies used by OAS and has unique knowledge of the RHC methodology used by OAS because he is the author of the methodology. Dr. Kvanli is a recognized author in the area of statistical auditing and the mixed distribution problem involving audit data. Dr. Kvanli is also the developer of the OAS Windows RAT-STATS 2007 statistical software, which is used by OAS to select statistical samples and calculate statistical estimates of savings and recommended overpayment recoveries. When modifications are needed, Dr. Kvanli is in the unique position, being the author of the software, to make any necessary changes and enhancements. Since 1988, Dr. Kvanli has provided OAS with expert advice, addressing legal challenges to statistical methods, computer software, and statistical estimates. The legal challenges to an audit can extend over many years. Dr. Kvanli is presently involved in addressing challenges to some of the OAS audits. Retaining Dr. Kvanli will assure his uninterrupted support in addressing ongoing challenges. Only Dr. Kvanli with his specialized expertise can provide this support. Dr. Kvanli is an author of the training materials for the OAS intermediate and advanced sampling courses that are taught to OAS auditors. Only Dr. Kvanli has an in-depth understanding of these materials. Dr. Kvanli has been a very effective instructor for OAS auditors and statistical specialists. Dr. Kvanli has an active knowledge of OAS sampling policy having helped OAS since 1988 to address statistical policy issues as they arise. There is no other entity with the innate and exclusive ability to provide the required statistical advisory and assistance services for OAS. Vendors who are interested in this acquisition should submit a statement of capabilities including detailed documentation supporting its ability to meet the Government’s requirements. The statement of capabilities must specifically demonstrate the following: (1) Demonstrate specialized experience in audit sampling, in particular multistage sampling designs in auditing and mixed distributions involving audit data. Show experience in developing computer appraisal programs to appraise audit data and in certification of computer programs. Demonstrate experience in working effectively with auditors. (2) Vendor must have a Ph.D. and strong academic background to be a credible expert witness before the board of appeals and in courts of law in the event statistical projections are challenged. Vendor must demonstrate proven exeperience in developing computer programs to perform simulation studies for policy evaluation and to appraise audit data. Vendor must have access to his own microcomputer that runs Microsoft Windows for computer program development and for analysis. Offeror must be an experienced instructor capable of communicating clearly and effectively to auditors, Statistical Specialists, and OAS statisticians. (3)Vendor must demonstrate understanding (a) of statistical methodologies and generally accepted statistical principles of statistical sampling in accordance with the required work and OAS Audit Policies and Procedures, Chapter 20-02, Sampling and Estimation Techniques in Auditing, (b) and problems and concerns of auditors in their use of sampling. (4) Proven experience for developing sound sampling methodologies and policy. Failure to submit adequate documentation will result in the Government proceeding with a sole source award to Dr. Kvnali. Responses must be submitted by August 28, 2008 to the Contracting Officer's email address No solicitation is available. A determination by the Government not to open the requirement to competition based upon responses submitted is solely within the discretion of the Government
