- This is a Notice of Contract Action in accordance with FAR 5.2. The U.S. Environmental Protection Agency (EPA) intends to enter into sole source negotiations with Waters Corporation, Milford, MA for a One (1) year maintenance agreement for a Waters Triple QUAD HPLC Mass Spectrometer with Electrospray interface attached to the UPLC Equipment identified below and operated by the stated MASS LYNX SOFTWARE> Addition, Two (2) Ultraviolet Detectors also manufactured by Waters are separate from this system but are included in this One (1) year maintenance agreement. This maintenance requirement includes all parts and labor necessary to repair this instrument, telephone support, and One (1) preventative maintenance visit. The U.S. EPA believes Waters Corporation is the only vendor capable of satisfying this requirement because Waters Corp are the manufacturers of the instrumentation and no other source has been identified as being able to service the equipment and that this software is proprietary in nature and Waters is the sole source for support, new version upgrades, and licensing of the MassLynx software, as they are the copyright and license holder, manufacturer, and owner of the software. The period of perform is expected to be for twelve (12) months 01 October 2008 through 30 September 2009. No request for quotations is available and this notice is not a request for quotes. All interested, responsible sources must respond by the respond date and shall include information on the proposed services which clearly supports the requirements outlined above. If no affirmative responses are received the Government will proceed with sole source discussions with Waters Corporation. Responses shall be sent to U.S. EPA, Region 1 Attn: Rosemary Melchior, One Congress Street, Suite 1100 MCP, Boston MA 02114-2023, or emailed to melchior.rosemary@epa.gov.
