Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This is a SMALL BUSINESS set-a-side with a North American Industrial Classification Systems (NAICS) OF 423120 AND 423130. Multiple firm fixed price purchase orders will be issued from this one solicitation for the purchase of automotive parts and tires. The term of the purchase orders will be from September 1, 2008 through December 31, 2008. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-26. The part numbers with the quantities will be found in Attachments A. BACKGROUND Customs and Border Protection has a requirement for various types of parts, oils and tires. The contractor shall provide and deliver or have available for pick up the various parts, oils and tires to CBP, Border Patrol Sector Garage, 2401 Dodson Avenue, Del Rio, TX 78840. The period of performance is from September 1, 2008 through December 31, 2008. The Government will accept partial deliveries. Deliveries shall be FOB destination. Contractor shall deliver all orders to the following location: •BORDER PATROL SECTOR GARAGE, 2401 DODSON AVENUE, DEL RIO, TEXAS 78840 The contractor shall ensure that all packages are marked, packed and preserved in order to ensure the bags arrive unharmed at the destination in accordance with the best commercial practices. Contractor shall coordinate delivery times, and if making partial deliveries, the quantities, with the Point of Contact at the Sector Garage. Contractor shall submit invoices on a monthly basis on partial deliveries. The following FAR clauses and provisions apply to this acquisition: 52.212-1 Instructions to Offerors-Commercial Items; and 52.212-3 Offeror Representations and Certifications – Commercial Items; Offerors are requested to provide a completed copy of this provision with their offer. Offerors shall complete annual representations and certifications on-line at http://orca.bpn.gov in accordance with FAR 51.212-3 Offeror Representations and Certifications – Commercial Items. If paragraph (j) of the provision is applicable, a written submission is required. FAR 52.212-4 Contract Terms and Conditions/Commercial Items applies. FAR 52.204-7 Central Contractor Registration; FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items applies to this acquisition Supervision Labor and Materials. The following clauses within paragraph 52.212-5(b) apply to this solicitation. FAR 52.222-21 Prohibition of Segregated Facilities. FAR 52.222-26 Equal Opportunity. FAR 52.222-35 Affirmative Action for Disabled Veterans and Veterans of the Vietnam Era. FAR 52.222-36 Affirmative Action for Workers with Disabilities. FAR 52.222-37 Employment Reports on Disabled Veterans and Veterans of the Vietnam Era. FAR 52.225-13 Restriction on Certain Foreign Purchases and FAR 52.232-33 Payment by Electronic Funds Transfer Central Contractor Registration. EVALUATION The Government will award Multiple firm-fixed price purchase orders from this announcement. Each part in Attachment A of this announcement will be evaluated for technical acceptability and price. Award will be made for each part and will be made to the offeror providing the lowest priced, technically acceptable offer per part. Therefore, every offeror that is awarded a purchase order will not receive the award for every part number. Price shall be evaluated for price reasonableness. The Government shall conduct its price analysis using one or more of the techniques specified in FAR 15.404-1(b). The Government will award the purchase orders resulting from this solicitation to the responsible offerors (as defined in FAR Part 9) whose offer per part number conforms to the solicitation, meets the technical requirements, and provides the overall most advantageous proposal to the Government, price being considered. Proposals are due at the Procurement office no later than August 22, 2008, by 11:00AM local time to the point of contact indicated below. In each proposal, the offeror shall specify that their proposal will be good for 45 days from the proposal due date (August 19). DEL RIO, TEXAS 78840 A written notice of award or acceptance of an offer(s), mailed or otherwise furnished to the successful offeror shall result in a binding contract without further action by either party. The Government does not intend on holding negotiations for proposals received in response to this announcement. However, if the Government determines after initial evaluations of all offers that it is in the best interest of the Government to hold negotiations, the Government reserves the right to do so. Before the offers specified expiration time (45 days from the proposal due date), the Government may accept an offer, whether or not negotiations are held after its receipt, unless a written notice of withdrawal is received before award.
