- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; The provisions and clauses incorporated herein are those in effect through Federal Acquisition Circular 2005-26, effective June 12, 2008. The Department of Veterans Affairs Medical Center/Employee Education Resource Center, Cleveland, Ohio proposes to enter into a non-competitive commercial item contract with FPMI Solutions, Inc, 101 Quality Circle, Huntsville, Alabama for the following: Item 1 -The Supervisors Guide to Federal Labor Relations, 6th Edition, ISBN 1-930542-27-5; quantity 5,000 each. Delivery location: Hines Distribution Center, 1st Avenue, One Block North of Cermak, Building 37, Hines, Illinois 60141. Delivery shall be made within 90 days after contract award. This solicitation is unrestricted and The North American Industry Classification System (NAICS) is 424920 and the small business size standard is 100 employees. ISBN 930542-27-5 is a special publication for the Department of Veterans Affairs thereby there is a reasonable basis to conclude that the supplies required are only available from this source. The proposed contract action is for supplies for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest by submitting a proposal. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The following provisions and clauses shall apply to this solicitation: 52.252-2 Clauses Incorporated by Reference. This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. Also, the full text of a clause may be accessed electronically at this/these address (es): http://www.arnet.gov/far (FAR) and http://www.va.govoa&mm/vaar/ (VAAR); 52.212-1 Instructions to Offerors Commercial Items; 52.212-3 Offeror Representations and Certification-Commercial Items. Offerors must include a completed copy of the FAR 52.212-3 Offeror Representations and Certification along with his/her proposal; FAR 52.212-4 Contract Terms and Conditions Commercial Items; 52.212-5 Contract Terms and Conditions Required to Implement Statutes on Executive Orders Commercial Items and in accordance with FAR 12.603(c) (2)(xii) the following provisions under the clause apply (b)(11)-(b)(16), (b)(19)(i), (b)(21), (b)(24) (b)(26) applies if Government Purchase Card is used, and VAAR 852.203-70 Commercial Advertising; 852.237-70 Contractor Responsibilities; and 852.270-1 Representatives of Contracting Officers. Proposals are due Friday, August 22, 2008 at 1:00 PM/Eastern Time.
