- NAICS Code: 334516 The U.S. Environmental Protection Agency (EPA) intends to negotiate a sole source purchase order under Simplified Acquisition Procedures to Magee Scientific, 2020 Stuart Street, Berkeley, CA 94703, for the acquisition of a AE31-Spectrum, Seven Wavelenght Aethalometer. Theinstrument must be able to measure black carbon at seven wavelengths (ranging from 370 nm to 950nm); The instrument must be able to collect real-time, high time resolution measurements; The instrument must have a calibration device for flow rates ranging from 0.3 to 30 1pm; The instrument must be portable; All applicable software and computer/data logger interface components that may required to communicate, control and store data from the instrument must be provided. The instrument will be used in a mobile laboratory for field study applications and will need to collect black carbon measurements. Magee Scientific Company is the original maker of the aethalometer and has exclusive copyrights, patents, and/or trade secret ownership and therefore the only vendor that can satisfy the requirement. The circumstance permitting is FAR 13.106(b) "only one source reasonably available". The intent of this notice is to determine if any other source(s) exist and therefore, no solicitation (RFQ) is available. Consequently, any response failing to demonstrate contractor's ability to provide maintenance of the instrument and instead choosing to merely submit a routine letter requesting a copy of the RFQ will be ignored. The information received in response to this notice will be considered solely for the purpose of determining whether or not to conduct a competitive procurement.
