Description
On June 26, 2003, the Federal Prison Industries, Inc. (FPI) Board of Directors passed a resolution directing FPI to limit the application of mandatory source to products for which FPI’s share of the Federal market is less than 20 percent. With the implementation of Section 827 of the Defense Authorization Bill of 2008, the manner in which the Department of Defense (DoD) procures from FPI has changed. Section 827 requires DoD to use competitive procedures when purchasing a product for which FPI has a significant market share, and requiring DoD to publish a list of product categories for which FPI’s share of the DoD market is greater than five percent. Therefore, Section 827 supercedes the 20 percent resolution implemented by FPI’s Board of Directors and the Board of Directors re-evaluated the need for the resolution for DoD products that have been affected. This notice informs the public that based on the meeting on August 14, 2008, the Board of Directors rescinded the application of this resolution for the following four FSCs which now fall under the recent DoD’s competition requirements for purchases from FPI: FSC 5995 - Cable, Cord, and Wire Assemblies: Communications Equipment FSC 6020 - Fiber Optic Cable Assemblies and Harnesses FSC 6160 - Misc. Batteries Retaining Fixtures and Liners FSC 6230 - Electrical Portable and Hand Lighting Equipment Interested parties have a right to raise questions at any time with FPI’s Board of Directors.
