Description
Department of Veterans Affairs, VA Boston Healthcare System, MA--Intent to sole source procurement under FAR 6.302-1, only one responsible source with BioSpherix, LTD PO Box 87 19 Demott Street Lacona, NY 13083 for the following items (brand name or equal): The Contractor shall provide same or similar product: Culture Chambers: Contractor shall provide a set of 2 culture chambers (two 2 shelf "C" chambers) will be designed to be inserted into any existing temperature controlled incubator with an access port hole at least 1.5 inch in diameter or flexible door seals through which cable and tubing of umbilicals can pass. Chambers will be built out of 0.125" clear Lexan. The "C" Chamber dimensions will be 14"w x 12"d x 6"h with a front door opening of 13.5"w x 5" h. Chambers will be built with one perforated stainless steel slide-out tray on which culture dishes can be placed. Inside each chamber the tray will have a usable surface area for plates of 12.75" x 10.25" with 2" clearance above the tray. Front door will hinge on bottom and close by magnetic latch. Chamber will include a removable stainless steel water pan bottom for humidification. Chamber will stand on 4 non-skid feet and will have an integral mount for OXYCYCLER actuator pods. Atmosphere controlled in chamber will be normobaric and designed to exhaust into host incubator, unless exhaust tubing (included) is used to direct exhaust outside host incubator to completely isolate chamber atmosphere from atmosphere of host incubator. OXYCYCLERTM controller: The controller will be a dual chamber O2/CO2 controller (OXYCYCLERTM model C42) designed to sit outside the host incubator and from this remote location be attached to the two chambers inside the incubator via 2 flexible hose/wire harness umbilicals threaded through the incubator access port. It will control normobaric gas oxygen tensions to within 0.1% over the full 0.1-99.9% range simultaneously in all chambers but independently in each. Control action will be bi-directional with oxygen gas infusion for raising oxygen and nitrogen gas infusion for lowering oxygen. It will control at any single oxygen setpoint or control at multiple oxygen setpoints with precisely timed changes from one setpoint to the next (profiles). Profiles can be started and stopped at any time in any chamber without affecting any other chamber. Each profile can consist of up to 20 different oxygen setpoints with virtually any rate of change from one setpoint to the next. Any profile can be cycled continuously or cycled any defined number of times up to 99 times. Any profile can be stored and repeated later at any time in any chamber. Any combination of different profiles can be run in different chambers simultaneously, or run sequentially in the same chamber. The controller will also control normobaric gas carbon dioxide tensions to within 0.1% anywhere over the 0.1-20.0% range, simultaneously in all chambers but independently in each. Control action will be bi-directional with CO2 gas infusion for raising CO2 and nitrogen gas infusion for lowering CO2. It will be able to keep CO2 level constant while oxygen is controlled at any single setpoint, or relatively constant while oxygen is changing during profile control. Profile control of CO2 will also be available in all 2 chambers. The government has determined that only one manufacturer can satisfy the agency's requirement and intends to negotiate with only one source. This notice of intent is not a request for competitive quotes. No solicitation is available and telephone requests will not be accepted. However any manufacturer that determines it can meet the requirements may give written notice through e:mail to Contract Specialist, Kimberly Perkins. At kimberly.perkins3@med.va.gov by close of business August 15, 2008 at 4:30pm. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to provide the above requirements at no cost or obligation to the government. All responses received will be evaluated by the government; however the information received will be considered solely for the purpose of determining whether to conduct a competitive procurement solely at the discretion of the government. If no responses are received the VA Boston Healthcare System will precede to sole source this requirement to BioSpherix, LTD Sole Source Justification JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION DIRECTIONS: Complete the "*" items, with as much detail as possible, sign by hand and fax to the Contracting Officer or sign by electronic signature and send back to the Contracting Officer via Outlook. *1. Identification of the service/department and the transaction/requisition #: Research Service/VA Boston Healthcare System. INFRASTRUCTURE 523-08-4-4909-0126 *2. Nature and/or description of the action being approved: Purchase of equipment for studies involving cellular and tissue oxidative stress research. *3. Description of the supplies/services required to meet the agency's needs (including the estimated value): OxyCycler C42 provides varying degrees of oxidative stress in cultured cells and tissues similar to those seen in ischemic and hypoxic disease conditions. 4. Identification of the statutory authority permitting other than full and open competition: FAR Part 6.302-1, Only one responsible source. *5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: BioSpherix Inc. is the only producer of this type of equipment, which is needed to satisfy the requirement for our service. Our research requires a 2 cell culture chambers since we need to examine hypoxic and reoxygenation conditions simultaneously. This innovative piece of equipment was introduced to the market recently. *6. Describe the efforts that have been made to ensure that offers are solicited from as many potential sources as is practicable, including whether a Commerce Business Daily notice was or will be publicized as required by Subpart 5.2 (copy attached) and, if not, which exception under 5.202 applies: The following vendors (include phone number and contact name) were contacted, however were unable to provide these services: 1. Only BioSpherix produces the type of OxyCycler needed for our research. 2 3. 4. 7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: *8. Description of the market survey that was conducted (i.e. names of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted: No other firm/vendor exist. *9. Any other facts supporting the use of other than full and open competition, such as - an explanation as to why technical data packages, specifications, engineering descriptions, statement of work, or purchase descriptions suitable for competition have not been developed or are not available. Based on our search, a competing vendor does not exit. BioSherix is the only producer of this equipment. *10. A listing of the sources, if any, that expressed an interest in the acquisition: Advertised on FEDBIZ *11. A statement of the actions, if any, that the department/service may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies/services is required in the future: CERTIFICATION I HEREBY certify that the date provided herein is complete and accurate to support other than full and open competition.
