- This is a notification that the Office of the Director, Office of Logistics Acquisitions Management intends to negotiate on a sole source order with Barbara Levy under Simplified Acquisition Procedures to provide Procurement Policy Services using other than full and open competition procedures pursuant to Federal Acquisition Regulations Part 13.106-1(b)-only one source reasonably available. Attached is the draft Statement of Work. Barbara Levy has comprehensive knowledge of the work, contacts and lines of reporting necessary to research and respond to the various special projects that arise. Her experience makes the assistance she can provide to DAPE staff unique and invaluable. In addition, Ms Levy has a wide breadth of knowledge of activities outside of DAPE, such as the Acquisition Integration and Modernization project at HHS, human subjects and inclusion of woman and minorities in research, etc. as well as a good understanding of the NIH environment based on her many interactions and service on various working committees over the years. She is fully able to function independently to provide the needed assistance and advice. Ms. Levy also has expert knowledge of U.S. Government and HHS contracting laws and regulations and NIH policies. Thus she has the balance of acquisition expertise and NIH experience that make her uniquely able to carry out special projects for DAPE. NIH knows of no one else who can fulfill this acquisition requirement within the timeframe necessary and with the degree of expertise and experience needed for the quick responses that are necessary in many instances. It would be cost-prohibitive to attempt to orient and train another contractor in the complexities and unique characteristics of the work required. Substituting another contractor would involve an extensive learning curve on the part of the new individual as well as increased and duplicative costs. The North American Industry Classification System is 541618 and the size standard is $7,000,000. This notice of intent is not a request for competitive quotes preparation. This notice of intent is not a request for competitive quotes. No solicitation document exists. Any firm that believes it can provide the stated capability within the established timeframe is invited to submit written notification to the Contract Specialist by August 30, 2008 at 1pm EST. Supporting evidence must be furnished in sufficient detail to demonstrate the firm's ability to provide the stated capability. Information can be sent to the Contract Specialist, Aleise Roberts at aleiser@od.nih.gov. No telephone requests will be accepted. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, NIH will proceed with the sole source purchase order.
