- Reference: NEEG3000-8-37800DXC DOC/NOAA/NESDIS Acquisition Management Division intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b) and FAR Subpart 6.302.1, Other Than Full and Open Competition 41 U.S.C. 253(c)(1)Only one responsible source and no other supplies or services shall satisfy the agency requirements. The proposed source is EMC CORPORATION, who is the copyright holder of the Legato backup operation system, and the only source known to NOAA. The items being purchased are the Legato backup operation systems for software and maintenance support. This software and associated documents and upgrades need to be kept up to date, taking into consideration improvements and changing hardware. The Government intent is to procure yearly software maintenance and technical support. This procurement action accomplishes this requirement. Offerors who believe they can meet this requirement are to submit in writing an affirmative response. The National Industry Classification systems (NAICS) code is 541511, and the size standard is $23M. No written solicitation will be issued. All written responses must include a written narrative statement of capability, including detailed technical information demonstrating their ability to meet the above requirements. The response must be sufficient to permit agency analysis to establish a bonafide capability to meet the requirements. Failure to submit such documentation shall result in the Government proceeding as stated above. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government. Affirmative written responses must be received no later than 15 days after publication of this synopsis. Proposal submissions must be submitted to the following contact person in acquisitions.
