- (i) This is a combined synopsis/solicitation for commercial items, prepared in accordance with the format in subpart 12.6 of the FAR and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a separate written solicitation will not be issued. (ii) The solicitation number for this requirement is RUAS-08-00165(A) and is being issued as a Request for Proposal. (iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-26. (iv) This procurement is unrestricted. The North American Industry Classification System (NAICS) code is 711510 – Independent Artists, Writers, and Performers. The Department of Homeland Security, Office of Procurement Operations intends to award a firm-fixed price purchase order (v) The contract line items numbers (CLIN) for this requirement are as follows CLIN ITEM TOTAL PRICE 0001 Current Secretary Portrait The firm-fixed price for CLIN 0001 shall be inclusive of the following: portrait, frame, backing and mounting hardware, shipping and delivery costs, and travel. (vi) See Attachment A – Statement of Work/Clauses. The Statement of Work will be incorporated into the awarded purchase order. (vii) The period of performance for this purchase order is September 30, 2008 through September 29, 2009. The items shall be delivered and accepted at the following address: DHS HQ, Office of Administrative Operations, 3801 Nebraska Avenue NW, Washington, DC. (viii) FAR 52.212-1 Instructions to Offerors - Commercial Items (Sept 2006) is incorporated into this solicitation. Offerors may obtain the full text version of this provision electronically at http://www.arnet.gov/far. Offerors shall submit the following information as part of their proposal: Technical Proposal Offerors shall submit: •A portfolio of four completed portraits. The portfolio must contain one portrait of each of the following four styles: full length figure, three quarter figure, half figure and head and shoulders. •The portfolio shall be submitted electronically in color PDF format. •Five references with the following contact information: name of reference, commissioning organization, job title, name of portrait subject, telephone number, and e-mail address. •Résumé for the individual artist which describes five completed portraits and includes the following information: name of portrait subject, commissioning organization, period of performance, total cost of portrait, portrait style and technique. Business Proposal Offerors shall submit the following: •Firm-fixed prices for CLINs 0001 and/or 0002 in Section V of this solicitation •Verification of CCR registration (go to http://www.ccr.gov for more information) •Verification of ORCA registration (go to https://orca.bpn.gov/ for more information) •Fill in and submit HSAR 3052.209-70 Prohibition on Contracts with Corporate Expatriates (located in Attachment A) •Acknowledge consideration of E-Verify in performing the purchase order. See http://www.dhs.gov/e-verify. (ix) The following FAR provision is incorporated into this solicitation: FAR 52.212-2 Evaluation—Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical Style/Approach Experience Past Performance The technical factors above are listed in descending order of importance. When combined the technical factors are more important than price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (This section is not applicable for this acquisition). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of Provision) (x) FAR 52.212-3 Offeror Representations and Certifications - Commercial Items (Nov 2007) is to be submitted with your offers. (xi) FAR 52.212-4 Contract Terms and Conditions - Commercial Items (Sept 2005) applies to this acquisition. (xii) FAR 52.212-5 Contract Terms and Conditions Required to Implement Statues or Executive Orders - Commercial Items (Jun 2008). See Attachment A – Statement of Work/Clauses for the full incorporation of the clause. The HSAR clauses 3052.209-70 Prohibition on Contracts with Corporate Expatriates and 3052.215-70 Key Personnel or Facilities are incorporated within Attachment A – Statement of Work/Clauses. (xiii) There are no additional contract requirements or terms and conditions for this solicitation. (xiv) The Defense Priorities and Allocations System (DPAS) is not applicable for this solicitation. (xv) There are no numbered notes for this solicitation. (xvi) Questions are due no later than Wednesday, September 10, 2008 at 1:00 p.m. EST.
