- Travis AFB intends to award sole source contract to Celerus Diagnostics located at 6950 Hollister Ave., Suite 104 Goleta, CA 93117 to provide (1) Celerus ImmunoHistoChemistry (IHC) staining system which consists of Celerus Wave Instrument, Celerus Wave Manager, laptop computer, wave slide label printer, PAC programmer, slide racks and rip Tide pressure cooker. This includes preventative maintenance, service agreement of the system, and reagents instruments costs per tests (see below list) in accordance with the Performance Work Statement dated 17 Jun 08. This is a four year commitment and at the end of the four year, David Grant Medical Center (DGMC) will obtain the equipment's title at no additional charge, which title will be transferred to DGMC. This is sole source due to the ability of system to process frozen tissue for intraoperative patients and it is a fully automated IHC tissue stainer designed to perform standardized IHC stains within 15-30 minutes allowing the user to stain frozen specimens (from patients who are simultaneously undergoing surgery procedures) within the required 20 minute time frame. No other system can stain quickly enough to perform IHC stains on frozen specimens that meet the College of American Pathologists' guidelines of 20 minutes in order to be able to be used as a diagnostic tool. There is no known service available in which to send out frozen specimens and no other equipment can perform this function in the allotted 20 minute timeframe, which puts physicians at a great disadvantage and putting patient's life at risk. In addition, the Celerus Wave System can perform routine IHC stains in addition to the staining on frozen tissue and does not incur hazardous waste removal at a substantial cost like other system. Period of performance is 1 Oct 08 through 30 Sep 09 with three option years as follows: 1 Oct 08 - 30 Sep 09 - Part 1 - Base Year 1 Oct 09 - 30 Sep 10 - Part II - Option 1 1 Oct 10 - 30 Sep 11 - Part III - Option 2 1 Oct 11 - 30 Sep 12 - Part IV - Option 3 This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-26 and Defense DCN 20080812, and the Air Force Acquisition Circular 2008-0605. This requirement is pursuant to Section 4202 of the Clinger-Cohen Act of 1996, as implemented by FAR 13.106-1(b)(1). The following FAR Clause is included in this solicitation: FAR 52.232-18 --Availability of Funds. Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.
