- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Solicitation number CFGC-08-SO-0192 is issued as a Request For Quotation (RFQ) under the Test Program for Certain Commercial Items (FAR Subpart 13.5). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-26. This procurement is not a set-aside. All responsible sources may submit a quotation. The Government intends to award one contract resulting from this solicitation. The period of performance of the contract will be one (1) year. As stated in the attached Statement of Work, the contractor shall furnish one, part-time (i.e., estimated 20 hours/week) counsel to augment the Commission's capabilities in administrative appeals and litigation, especially relating to employee relations matters. The provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. There are no addenda applicable to the provision. The provision at 52.212-2, Evaluation-Commercial Items, is applicable to this procurement. The specific evaluation criteria to be included in paragraph (a) of that provision are: (1) Technical Capability to Meet CFTC's Requirements (reference checks may be conducted on some of the resumes) - Based on an initial review of the submitted resumes, CFTC may elect to conduct interviews with one or more of the proposed candidates; and (2) Price. The evaluated price will be the proposed not-to-exceed amount for the project. As part of this evaluation, CFTC may also conduct a price realism analysis. CFTC may award the contract to other than the lowest priced offeror. From the standpoint of the relative importance of price to the technical criteria, the technical criteria are significantly more important than price. However, as the merit of technical factors in competing quotations approaches equality, price will become increasingly more significant as an evaluation factor. Offerors shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with their quotation. The clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition. There are no addenda applicable to the clause. The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. Q uotations shall include the following: (1) Provide a resume for the proposed individual showing complete work and education history and demonstrating the experience and qualifications necessary to successfully perform the work. The resume shall also include three (3) references from other organizations (i.e., not the quoter) that can discuss the individual's experience and performance performing work similar to that required by CFTC. (2) Price: Provide a fully-loaded labor rate for the proposed individual, multiplied by 1,000 hours to arrive at the proposed not-to-exceed price for the contract. The CFTC expects to evaluate quotations and award a contract without conducting discussions and/or soliciting quotation revisions. Therefore, the offeror's initial quotation should contain the offeror's best terms from a price and technical standpoint. However, CFTC reserves the right to conduct discussions if later determined by the CFTC Contracting Officer to be necessary. Quotations are due no later than 3:00 p.m. local (Washington, DC) time on September 18, 2008. The quotations shall be submitted to the attention of Contracting Officer William M. Roberson, and may either be delivered to the address specified above or submitted via email to wroberson@cftc.gov. The Contracting Officer may be contacted on (202)418-5367.
