- Notice of intent to award a sole source purchase order to the Superior Fire Protection, Inc. The award will be made for the purchase of the services described below. This procurement is being conducted under Federal Acquisition Regulation (FAR) Part 6.302-1, for Other than Full and Open Competition and FAR Part 13, Simplified Acquisition Procedures. All inquiries and concerns must be addressed in writing to USPFO for Tennessee Contracting Division Attn: David Reagan, PO Box 41502 Nashville, TN or sent by email to paul.david.reagan@us.army.mil. Telephone requests or inquiries will not be accepted. Responses to this notice shall be received no later than 12:00 Noon Central Daylight Savings Time, Tuesday, Sept. 30th, 2008. A determination not to compete this requirement is within the discretion of the Government. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. The point of contact for this announcement is P. The following justification and approval is provided for other than full and open competition for this purchase. 1.This request for justification for other than full and open competition is for a contract to provide the Installation of a FE-25 Fire Suppression System described below for the Tennessee Army National Guard. 2.These services are to be performed: a FE-25 Suppression System is to be installed in the Emergency Operations Center (EOC) room sub floor, at the JFHQ Building due to the fact that a listed sub floor 1 or greater has been installed in the EOC room for the purposes of installing cabling both high and low voltage making the room compliant with fire marshal approval for EOC occupancy and use to meet the requirement. In order for this room to be utilized by EOC, this follow-on contract must be executed to clear codes and to make the room and therefore the building acceptable and usable. Superior Fire Protection, Inc. is the only organization who can execute this contract, since this vendor installed the complete building fire suppression system. Superiors installation in the EOC room will tie-in to the existing fire suppression system and will not impact their current suppression system warranty and Superior will amend and extend their warranty on the EOC room suppression system. Furthermore, the Prime Contractor for the building has confirmed in writing to the Government, that if Superior Fire Protection mods the suppression system, to include only the EOC room, it will NOT impact the one (1) year Warranty of Construction. 3.The total estimated value of these services is on file at this contracting office and can be obtained through Freedom of Information Act procedures. 4.Statutory Authority: FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements as it is the only vendor that can perform this work without voiding the system warranty. 5.The Superior Fire Protection, Inc. has current system knowledge and expertises required for these services and have technicians who are technically qualified to perform the service, therefore making them the only source capable of fulfilling this requirement. 6.Efforts to solicit other contractors will be made via http://www.fedbizopps.gov in accordance with FAR 5.2. A Notice of Intent to Award Sole Source will be issued on Monday Sept 29th, 2008. 7.The anticipated cost of this acquisition is determined fair and reasonable by comparison of prices proposed by the offerors of items that previous and similar type projects executed by this vendor. 8.There are no other facts to support the use of other than full and open competition. 9.No other firms expressed an interest in this acquisition. 10.No actions to remove barriers to competition will be taken, as the Superior Fire Protection, Inc is the only known vendor who can provide this service as outlined in paragraph two. 11.This justification is accurate and complete to the best of my knowledge and belief. FMO Division of the Tennessee Army National Guard Scope of Work EOC Fire Suppression System This project will consist of the installation of a Sub-Floor Fire Suppression System. The sub-floor is located in the EOC (Room 108) on the first floor of the JFHQ building. Sub floor area covers 1,080 sq ft, (24 x 45). Fire suppression tanks will be located in equipment room 108C. Contractor will provide all equipment and labor to include technical labor. Contractor will provide a main cylinder with a connected reserve cylinder for the sub floor only. Contractor will provide all mechanical piping, electrical materials/controls, and all other associated detection equipment for the sub floor only. Contractor will leave all currently installed Fire Suppression equipment including tanks, piping, and equipment in place. Work, when completed must meet all code requirements/approvals to meet occupancy approvals.
