- The National Institutes of Health (NIH), National Cancer Institute (NCI), Center for Cancer Research (CCR), intends to procure on a sole-source basis with BD Biosciences, 2350 Qume Dr., San Jose, CA 95131 for a maintenance agreement for government owned FACS Aria Special Order Cell Sorter (s/n P46900083). This acquisition will be processed in accordance with simplified acquisition procedures as stated in FAR Part 13.106-(b)(1). The North American Industry Classification System Code is 811219 and the business size standard is $6.5M. Period of performance: November 19, 2008 or date of award, whichever is later, through one year. The FACS Core Facility provides flow cytometry and cell sorting support to all the laboratories in the NCI Center for Cancer Research. The FACS Core has a FACS Aria Special Order Cell Sorter (S/N P46900083) that was installed in September of 2007 with a one-year warranty. It is in use 4 to 5 days per week providing cell sorting services to investigators from 28 NCI labs and branches. The contractor shall provide: 1) Two (2) preventive maintenance inspections per Service Agreement year; 2) unlimited emergency repair within forty-eight (48) hours of first call; 3) furnish all required replacement parts with the exception of consumable parts at no additional cost to the Government. Contractor personnel shall be trained by the manufacturer in the servicing of the equipment in order to perform service to this instrument. It is critical that these instruments remain in excellent operating condition at all times. It is also important that the quality of the results from these instruments be kept at a consistently high level. Many of the experiments, if unable to be run on the cytometers or sorters as scheduled, cannot be rescued. In addition to maintenance in peak condition it is critical that software upgrades and product corrective actions remain current. NCI also depends heavily on qualified telephone troubleshooting and technical assistance from the manufacturer's staff. The manufacturer, BD Biosciences, has many trained Field Service Representatives in the immediate area in order to provide fast response times on service calls. These Field Representatives are uniquely qualified as they are trained by the manufacturer and the manufacturer provides frequent updated continuing education for them. They are the only known qualified company to provide software and hardware upgrades. BD Biosciences also keeps a full inventory of parts in their warehouses that can arrive on-site by the following morning to replace items that cannot immediately be repaired and returned to service. This is not a solicitation for competitive quotations. However, if any interested party believes it can meet the above requirement, they may submit a statement of capabilities. All information furnished shall be in writing and must contain sufficient detail to allow the NCI to determine if it can meet the above unique specifications described herein. An original and one copy of the capability statement must be received in the NCI contracting office by 1:00 PM EDT on October 22, 2008. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. In order to receive an award, contractors must have valid registration/certification in the Central Contractor Registration (CCR) www.ccr.gov and the Online Representations and Certifications Applications (ORCA), http://orca.bpn.gov.
