- This synopsis provides the Government's intent to solicit and award a sole source FFP Purchase Order, utilizing the procedures of FAR Part 12, to Gary Stumpf Cultural Resource Consulting, Phoenix, AZ. The DOI/BLM/National Training Center (NTC) has a requirement on a sole source basis for a purchase order with Gary Stumpf to Develop/Revise, prepare, and instruct the: BLM 8100 Manual Series; Section 106 Case Studies; Cultural Resource Use Permits; Planning and Proactive Management; Adventures in the Past; Native American Graves Protection and Repatriation Act (NAGPRA); and Sacred Sites and Tradition Cultural Properties. Contractor shall also convert each of the above listed modules into Distance Learning format, including filming instruction. Please see below project details regarding this requirement. The Bureau of Land Management (BLM) National Training Center and the BLM Preservation Board is developing courses in the BLM Cultural Heritage Resource Curriculum as established by the BLM's Preservation Board. These courses are to fulfill requirements of the 1997 National Programmatic Agreement (NPA) in order to meet BLM's responsibilities under Sections 106 and 110 of the National Historical Preservation Act (NHPA). An important core course in the Curriculum is Course 8100-01, which provides BLM field office archaeologists and managers with a high level of professional knowledge that prepares them to implement the Cultural Heritage program at the field office level. The requirement is for the following services: Part I: Development or revision, preparation, and delivery of this course will require the services of contract consultant/experts to: 1) meet and coordinate with the BLM Preservation Board Training Committee and BLM instructors, 2) develop/revise lessons for presentation, along with any materials required to support the lessons, and 3) instruct specific portions of the course. This course is extensive and in-depth. It will be taught four and one half days, Monday through Friday, in February 2009, at the BLM National Training Center in Phoenix, Arizona. The contractor is expected to be present during this entire time to do the required teaching of the seven units outlined below. Also, there will be ongoing coordination with other instructors, Preservation Board Training Committee members, and BLM National Training Center personnel via phone and internet. Part II: In addition to the classroom presentation of the course, and following the implementation of the classroom course, the 8100-01 course will be converted to Distance Learning format. This includes meeting and coordinating with BLM Preservation Board, and NTC design group members re: development and revision of content and materials, and converting course materials for contracted units into distance learning format. It also includes instructing modules in appropriate distance learning methods [for example, filming instruction, on-line instruction, etc.] The work requirements of the contractor are described below from sections of the 8100-01 course outline. All expertise required must be relevant to the knowledge of the laws, policies, processes and practices, and the management of the BLM's Cultural Heritage Program. Course Objective: The BLM's National Programmatic Agreement and associated state protocols require that BLM Cultural Heritage Staff of professional archaeologists and line officers have a comprehensive understanding of the NPA, state protocols, relevant law, executive orders and agency direction and guidance and policy regarding the management of archaeological and historic resources. Upon completion of this course, Cultural Heritage staff and managers will fully understand these laws, regulations and guidance/direction and their relationship to the NPA and state protocols, to fully implement the Cultural Heritage Program at the field level, and to provide BLM's line management with a high level of professional knowledge to assist BLM's field managers to make wise, informed decisions and determinations concerning heritage resources. The contractor is expected to possess both a broad and in-depth knowledge of cultural resource management and legal issues pertinent to BLM's responsibilities. As an instructor, the contractor should expect to receive complex questions from students and be prepared to respond by providing sound, professional advice and guidance to these issues and questions. The contractor should be prepared to provide specific case examples in responding to these questions. The contractor will be expected to develop/revise lesson plans and materials, and teach units on the following seven topics using appropriate media; all lesson plans, materials and media will be submitted to the BLM NTC for permanent course files. Teaching Module: 8100 MANUAL SERIES (45 minutes) Objective: Understand the purpose of the Manual, its organizational structure and general content. The contractor is also required to provide: Questions for the course pre-test to help participants understand the organization and content of manuals. A url link to manuals (e.g., Heritage website). Summary and discussion of each manual section including:-Purpose-Objective-Policy-Content-Issues highlighted-Procedures Teaching Module: SECTION 106 CASE STUDIES (90 minutes) Part of a series of increasingly complex Section 106 cases for analysis to increase participant's understanding and competency. Objective: Participants will understand through use of a case study BLM's general responsibilities for Section 106 for federal vs. non-federal land (excluding mitigation). The contractor will develop and teach information on a case study with the following features, issues and content: -Checkerboard land ownership pattern and in-holdings-Rights-of-way-Corners-crossings-Federally-authorized actions on split estate Teaching Module: CULTURAL RESOURCE USE PERMITS (60 minutes) Objective: Participants will understand the purposes and processes for Cultural Resource Permits including relevant authorities, permit types, review and issuance, qualifications required to obtain a permit, processing, monitoring, suspension and revocation, and legal recourse for non-compliance. The contractor is expected to cover the following topics;-Relevant statutes and authorities for the issuing of permits-Who may apply for permit-BLM responsibilities (state office/field office) for issuing and administering permits-BLM processes for evaluating permit applications-Process for issuance of permits-Administration of permits and monitoring of permit holder's performance and compliance with permit stipulations-Field use authorizations-Curation agreements-Reporting requirements and evaluation-Procedures intitiating revocation, suspension-Procedures and responsibilities for revoking and suspending permits-Procedures for appeals by permit holders/applicants Teaching Module: PLANNING AND PRACTIVE MANAGEMENT (90 minutes) Objective: Provide students with a thorough understanding of BLM's non-Section 106 program and responsibilities to proactively manage cultural resources in accordance with FLPMA, ARPA, and the NHPA Section 110. As a part of a three person team teaching this module, the contractor is expected to provide instruction using a real case study of a cultural resource enhancement project in which the contractor has been substantially involved in the planning (project design and budgeting/funding) and implementation of a significant cultural resource enhancement project of a heritage resource, and one that resulted in delivery of products to be publicly enjoyed and appreciated. A case study involving significant partnership participation is desired. Teaching Module: ADVENTURES IN THE PAST (30 minutes) Objective: Summarize Preserve America Executive Order, Enduring Legacy, Adventures website. The contractor will develop and teach information on BLM's Cultural Heritage Program to address the Preserve America Executive Order. Teaching Module: NATIVE AMERICAN GRAVES PROTECTION AND REPARTRIATION ACT (NAGPRA)(45 minutes) Objective: Participants will understand the law, its basis, requirements and agency officials' responsibilities to implement the law. The contractor will develop and teach information topics to be taught: -History of the legislation-Definition and terms-Pre-1990 vs. Post-1990 procedures for compliance with the law-Requirements for:Summaries;Inventories;Determinations of Cultural Affiliations;Unaffiliated Remains/Cultural Items;Notification to Tribes for Inadvertent and Planned Discoveries;Treatment Plans;Transfer of Custody (post-1990);Repatriation (pre-1990);Unclaimed Remains/Cultural Items;Reburial of NAGPRA objects on public lands; and the contractor will also present summary information on further training in NAGPRA. Teaching Modules: SACRED SITES AND TRADITION CULTURAL PROPERTIES (2 hours) Objective: Using case study examples and discussion, participants will understand authorities and processes for implementing responsibilities to Traditional Cultural Properties and Sacred Sites. Topics to be covered include:American Indian Religious Freedom Act;Executive Order 13007 (Sacred Sites);BLM's 8100 Manual and Handbook Direction for considering Traditiona; Cultural Properties and Sacred Sites in BLM's land use planning and land use decisions. Case examples: The contractor should be prepared to provide case examples of significant cases involving BLM in the consideration of/resolution of adverse effects to Traditional Cultural Properties/Sacred Sites. Cases should include specific examples of process, policy, and court rulings. Experience and Qualifications required of the Instructor(s): 1. Thorough understanding and experience in interpreting the following for BLM Managers and Cultural Heritage Staff:a. BLM's 8100 Manual Seriesb. The BLM, the Advisory Council on Historic Preservation, the National Conference of State Historic Preservation Officers, and the National Programmatic Agreement for the management of cultural resources.c. National Historic Preservation Actd. Archaeological Resources Protection Acte. Federal Lands Policy Protection Act and bureau guidance/direction for the consideration if cultural resources in land use planning.f. National Environmental Policy Act and the consideration of cultural resources during land-use authorizations.g. Native American Graves Protection and Repatriation Acth. President Bush's Preserve America Executive Orderi. Executive Order 13007j. BLM's cultural resource use permitting process for cultural resources inventory, limited testing and data recovery (including review, issuance, administration, revocation, suspension, modification, notification to tribes. 2. Demonstrated experience in providing professional guidance, direction,negotiation and leadership for NHPA Section 106 compliance and consultation for complex undertakings involving cultural resources affected by authorized land-use actions. Experience dealing with resources and land-use authorizations highly similar to those dealt with by BLM is especially sought for this training. 3. Demonstrated professional experience and knowledge for considering complex Cultural heritage properties possessing traditional cultural and/or religious values during land use authorizations. In addition, the contractor is expected to possess a thorough knowledge and understanding of BLM's legal requirements for identifying, evaluating and assessing/resolving affects to these specialproperties. 4. Demonstrated experience and knowledge to implement the NAGPRA and BLM's direction for implementation of NAGPRA including procedures for dealing with planned excavations and inadvertent discoveries and notification to and consultation with tribes, determination of cultural affiliation, transfer ofcustody/repatriation, unclaimed items, and re-burial of NAGPRA objectson public lands. 5. Demonstrated experience in administering and providing guidance and directionfor proactive management of cultural resources including: requirements ofNHPA Section 110 and other relevant direction (e.g., Preserve America EO),the development of partnerships to cooperatively manage cultural resources onpublic lands and in planning funding, and implementing feasible public outreachand education efforts. 6. Demonstrated experience in designing, developing and instructing courses and modules in BLM Cultural Heritage Resource Program management and in designing and developing Distance Learning products for Cultural Heritage Resource management. Deliverables by Contractor:The National Training Center requires course contractors to provide to the training coordinators the following deliverables:Lesson Plan/Content Outline by NTC deadline date;Materials for Handouts and Notebooks by NTC deadline date;and Provide lesson media, as appropriate (e.g., PowerPoints, slides, overheads, historic period artifacts, etc.). The contractor will participate and provide the coordination necessary prior to the delivery of the course. The proposed contract action for which the Government intends to solicit and negotiate with only one source is based on the authority of FAR 6.302-1. Interested persons may identify their interest and capability to respond to the requirement. This notice of intent is not a request for competitive proposals. Responses to this notice must be received no later than 8:00 PM EST Sunday, November 9, 2008. A determination by the Government not to compete this proposed purchase order based on responses to this notice is solely within the discretion of the Government. This notice may represent the only official notice. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government.
