Classification Code: NAICS: 541711 Proposed Solicitation #: W81K04-09-T-0004; Opening Date of Synopsis: 3 November 2008 Closing Response Date: 7 November 2008 4:00PM Central Standard Time. Delivery Schedule on or before 19 November 2008. Anticipated Award date 14 November 2008. In accordance with the Federal Acquisition Regulation (FAR) part 5.207 (b)(15)(ii) all responsible sources may submit a capability statement, proposal, or quoatation, which shall be considered by the agency. Note 22. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within three days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This is a follow-on contract for the exact same reagent requirement used on the Applied Biosystems 3730 and 3130 Genetic Analyzers Equipment. No effort will be made to solicit offers since Edge Biosystems is the only manufacturer and only responsible source that provides the reagent products that incorporate the Armed Forces Institute of Pathologys current validated sequencing procedures with the Applied Biosystems 3730 and 3130 Genetic Analyzer. The use of any other manufacturers reagents requires various validation procedures involving significant man-hours and efforts lasting approximately 6 to 12 months during which time the normal daily operation of identification of US service members using DNA will be suspended. The following provisions and clauses will be incorporated by reference: IAW FAR 19.1406 (a)(1)FAR 52.212-1 Instruction to Offerors Commercial Items FAR 52.212-2 Evaluation Commercial Items The contract will be awarded to the Best Value with consideration for: 1. Technical Acceptability The reagents must meet the Governments Brand Name Requirement in order to be considered technically acceptable. 2 Price The price must be considered fair and reasonable within the industry standards. Technical Acceptability/Capability are more important than price. Clause 52.211-6 (and other clauses throughout this solicitation can be viewed and can be downloaded by accessing the website listed in this solicitation. The technical evaluation will be a determination based on information furnished by the vendor. The Government is not responsible for locating or securing any information which is not identified in the offer. The Government reserves the right to make an award without discussions. The Government reserves the right to award on all or none basis. FAR 52.212-3, Offerors Representations and Certifications Commercial Items- Vendors shall include a completed copy of FAR provision 52.212-3 with their offer. An offeror shall complete only paragraph (l) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (b) through (k) of this provision.
