Description
The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with FEI Company, of Hillsboro, Oregon for the purchase of an EFTEM Lens Upgrade for NIST’s existing FEI CM300FEG Analytical Electron Microscope under other than full and open competition by the authority of FAR subpart 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements. The NIST Chemical Science and Technology Laboratory requires an EFTEM Lens Upgrade for its existing FEI CM300FEG Analytical Electron Microscope so that the nominal magnification of the instrument matches that which is achieved with its imaging energy filter. The imaging energy filter allows digital imaging to be performed with electrons in a narrow band of energies, providing greater contrast in traditional elastic imaging and compositional contrast with electrons inelastically scattered in the specimen. However, the imaging energy confers an increase in magnification by about a factor of twenty relative to that on the viewing screen, and thus images acquired at a nominal microscope magnification (e.g., 4000x) would have an actual magnification of ~80,000x. This magnification bump does not allow digital imaging at a magnification of less than 50,000x, since the lowest nominal magnification of the CM300 is about 2,500x. This limits the utility of the imaging filter for larger fields of view that must be images at lower magnifications that 50,000x. The EFTEM lens mode upgrade provides a series of lens settings that corrects for the 20x increase of magnification of the imaging filter, so that the images thereby acquired have the same nominal magnification as the microscope. FEI Company developed this lens series within the last decade in order to respond to customer demand for accessing these lower magnifications with the imaging filter, and to provide a magnification at the filter that is roughly in correspondence with the nominal magnification of the microscope. No other company has developed such a series of lens settings, nor would have the incentive to do so, as the CM300FEG Analytical Electron Microscope is no longer in production. FEI Company is thus the sole provider of this upgrade. Delivery shall be FOB Destination, Gaithersburg, MD, and be completed in accordance with the Contractor’s commercial schedule. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 3:00 p.m. (EST) on November 29, 2008. Inquiries will only be accepted via email to paula.wilkison@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
