- Friday, November 14, 2008 The Department of Veterans, VA Boston Healthcare System, has a requirement for vendor, Dako Corp., in Carpinteria, CA 93103 for Reagents to be used in conjunction with the Artisan Staining System. The estimated amount of the service is calculated at/about $5.60 - $10.20 per slide (kit size changes to tests per kit or 100 tests per kit) for on/about 4,200 slides. It is the Governments intention to solicit and negotiate only with this source. Please refer to the Sole Source Justification. This is not a solicitation; it is notice of intent to sole source a requirement. Inquires/information received after established deadline of November 19, 2008 shall not be considered. The submission of any data for review shall not impede award of this contract as planned. The Government does not intend to pay for information solicited. This synopsis is issued pursuant to FAR 6.302-1. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1)Identification of the agency and the contracting activity. VA Medical Center, Purchasing & Contracting. 2)Nature and/or description of the action being approved. Sole Source procurement for the artisan staining system reagents. 3) Description of the supplies or services required to meet the agencys needs (including the estimated value.) Please include the IFCAP transaction number, dollar value and a description of the item being sought. Transaction # 523-09-4-7455-0027 Dollar value: N/A Reagent cost: $42,840 Item Description: -Reagents to be used in conjunction with the Artisan Staining System. Estimated costs of reagents are listed in formal Quotation. We will need amounts for staining approximately 4,200+ slides, using the average pricing of $5.60-$10.20 per slide ( kit size changes - 50 tests per kit or 100 tests per kit). 4)Identification of the statutory authority permitting other than full and open competition. FAR 6.39201, only one responsible source. 5)Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. The reagents are specifically packaged for use in the Artisan Staining System. The reagents provide uniform results in staining quality and eliminate manual application. The reagents can be customized to fit the needs of the VAMC. The reagents are sequenced to correlate with the computer software of the Artisan Staining System 6)Description of efforts made to ensure that offers are solicited from as many potential sources as is practical, including whether a Commerce Business Daily notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. The vendor, Dako Corp is the only vendor that can supply these reagents. It had been servicing VA for FY08. We tried to contact other vendors; however, they were unable to provide the same services. Will post on FBO for 5 days from November 14, 2008 16:00 pm EST November 19, 2008 16:00 pm EST. 7)Determination by the contracting officer that the anticipated cost to the government will be fair and reasonable. As stated, in item #5, DAKO CYTOMATION has five unique features to the Artisan staining system they are; The instrument performs IHC and special stains simultaneously on one compact instrument (improves lab efficiency). 48 slide capacity and 50 reagent capacity. Handles many if not all the labs no routine staining needs in a single run. Protocol customization, develops individual protocols to satisfy pathologist staining preferences. Individual slide heating capability, improved special stain quality. All reagents/antibodies available for the artisan are unique to that equipment. 8) Description of the market survey conducted (i.e. names of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted. Same as #6. 9)Any other facts supporting the use of other than full and open competition, such as an explanation why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. None. 10)A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. None to date. 11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. As stated above, this vendor had the unique features that would meet and exceed the needs of the lab. In the future, this may not be the market situation and this would not be a factor limiting competition.
