Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 and supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-27 dated Sept. 17, 2008. The Government intends to make a Best Value award as the result of this solicitation, therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. This posting is to inform potential providers that the Environmental Protection Agency (EPA), Office of Radiation and Indoor Environments National Laboratory (R&IE) has a requirement for an Ambient Ozone Analyzer. The North American Industry Classification system code is 334513. The size standard is 500 employees. The provisions in FAR 52.211-6 Brand Name or Equal and 52.212-1, Instructions to Offerors-Commercial Items, are applicable to this solicitation. The provision in FAR 52.212-2 -- Evaluation -- Commercial Items is applicable to this solicitation as follows: Evaluation -- Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical Capability, Past Performance, and Price. Technical Capability and past performance, when combined, are more important than price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of Provision) Past performance is defined as previous customers that have purchased the item being offered. Offerors must submit point of contact name and phone number. As of 1 January 2005, offerors are required to complete online representations and certifications at http://orca.bpn.gov which are identical to what is required in FAR 52.212-3, Offeror Representations and Certifications-Commercial Items. In addition, the following clauses and provisions apply: FAR 52.212-4, Contractor Terms and Conditions-Commercial Items; FAR 52.204-7, Central Contractor Registration; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items with the following paragraphs checked as applicable: (16), (18), (19), (28), and (36); THE RESPONSE DATE FOR THIS REQUEST FOR QUOTATION IS November 26, 2008, 3:30 PM PST. Email to pearlman.holly@epa.gov or fax (702) 784-8202. Quotations (including delivery date) should be sent via e-mail or fax. All offerors are responsible to confirm the successful transmission of electronic data. Late responses will not be considered. This announcement constitutes the only solicitation, which is issued as a Request for Quotation (RFQ); quotes are being requested and a written solicitation will not be issued. The Government intends to acquire a commercial item using FAR Part 12 and the Simplified Acquisition Procedures set forth in FAR Part 13. Questions regarding this acquisition must be submitted in writing, via email, pearlman.holly@epa.gov, no later than November 12, 2008. It is the offerors responsibility to monitor this site for the release of amendments (if any). Potential offerors will be responsible for downloading their own copy of this notice, the on-line RFQ and amendments (if any). CCR Requirement - Company must be registered on Central Contractor Registration (CCR) before an award could be made to them.
