- The Pension Benefit Guaranty Corporation (PBGC) intends to negotiate an order with Colin England, Wachovia Bank National Association, Actuarial and Benefits Consulting Division, 11150 Sunset Hills Road, Suite 200 Reston, VA 20190. This procurement is being conducted under Simplified Acquisition Procedures (SAP) and only one responsible source will satisfy agency requirements. PBGC is seeking an expert consultant to analyze actuarial issues and provide consulting services in connection with James Stephens, et al. v. PBGC. Based on our review of Mr.England's resume, interview, and the results of our overall search for Actuarial experts, PBGC intends to retain Mr. England as a consultant. The Contractor will perform task upon assignment from PBGC which are expected to include, but are not limited to: a) reviewing pleadings, plan documents, administrative records, benefit applications, benefit statements and various other documents; b) reviewing lump sum benefit calculation methods and distribution procedures, and comparing them to a sample group of actual lump sum calculations and distributions by plan administrator; c) analyze information for approximately 1,400 putative class members regarding the calculation and payment of their lump sum benefits; d) evaluate the alleged violations of the plan documents and ERISA in the calculation and distribution of lump sums by US Airways; e) assisting in preparing and responding to discovery request; f) calculating the amount of damages, if any, that may be owed to plaintiffs; and g) performing any additional necessary expert consulting work requested by PBGC in connection with the case. This notice is not a request for competitive quotes. However, statements of capability to fulfill this requirement received from other responsible parties prior to 1:00 PM November 21, 2008 will be evaluated, for purposes of determining whether to conduct a competitive procurement.
