- Document Type: Sources Sought Notice for Privacy Security Solicitation Number: APP # 90378 Posted Date: December 04, 2008 Current Response Date: January 05, 2009 Current Archive Date: January 07, 2009 Classification Code: R -- Professional, administrative, and management support services Contracting Office Address Department of Health and Human Services, Centers for Medicare and Medicaid Services, Office of Acquisition and Grants Management: 7500 Security Blvd. C2-21-15 Baltimore, MD 21244-1850 Description This is a Sources Sought Notice to determine the availability of potential small businesses (e.g., 8(a), service-disabled veteran owned small business, HUBZone small business, small disadvantaged business, veteran-owned small business, and women-owned small business) and or large businesses capable of assisting in addressing privacy related matters as they relate to the incoming administration’s health care goals and initiatives. Background CMS operates as a health plan under HIPAA, as well as a federal agency that is subject to the Privacy Act. Recently, there have been numerous security and privacy breaches reported in the news, including data losses by federal agencies and their contractors. As a result, federal agencies are now subject to additional OMB requirements involving risk assessment for identity theft and breach notification. The continued heightened awareness of privacy and identity theft is coming at the same time the CMS is becoming more than a payer of health care services and being recognized as a key contributor to public health. Part of that transformation involves the sharing of CMS data with organizations and entities that are unprecedented. This transformation is expected to continue with the new Administration. The agency will be disclosing personal health information to conduct expanded program operations and studies that promote high value health care and consumer informed choice, along with programs that promote quality and transparency and improve the interoperability of data systems across the health system. All of these initiatives must be conducted within the legal and regulatory framework, in compliance with the federal privacy requirements and OMB guidelines. Expertise Being Sought CMS’ Office of E-Health Standards and Services is seeking contractors who are capable of assisting in addressing privacy matters as they relate to the incoming administration’s health care goals and initiatives. Deliverables during the contract life may include, but not limited to providing expert advice, consultation and written products, such as white papers. CMS is searching for contractors that have a broad range of experience, knowledge and expertise. In order to respond to this notice, contractors shall demonstrate experience with and or be able to perform (experience and or ability to provide) all of the following as well as justify the capabilities and experience: • Governmental Affairs • Privacy and Security Laws and Regulations • Privacy Advocacy • Knowledge and Experience with the Privacy Act of 1974 • HIPAA Privacy Rule • Federal Information Security Management Act of 2002, and other privacy/security related standards and guidelines, such as those published by the Office of Management and Budget and the National Institute of Standards and Technology. • Knowledge of current trends in information sharing that include health information concerns and approaches to increase interoperability among the public and private sectors for such things as personal and Electronic Health Records and Provider Quality Performance and Measurement • Strategic Analysis of issues related to privacy and help the agency clarify and resolve common data governance challenges that ensure the appropriate balance between Medicare and Medicaid program requirements and privacy • Development of deliverables that research solutions ensuring privacy, security, trust, and agency compliance within a potentially new data sharing environment. Capability statements will not be returned and will not be accepted after the due date. CMS shall not be responsible to answer questions on the notice and contractors shall not incorporate anything proprietary in their submissions. The maximum number of pages for submission is 8 pages. This is not an invitation for bid, request for proposal or other solicitation and in no way obligates CMS to award a contract.
