- 17.This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are not being requested and a written solicitation will not be issued. The solicitation number for this acquisition is NOI9014 and the solicitation is being issued as Notice of Intent on a sole basis. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-28 This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is not a small business set-aside. All responsible sources may submit an offer that will be considered by this agency. The North American Industry Classification System Code (NAICS) for this acquisition is 811219 and the small business size standard is $6.5. The National Institute of Allergy and Infectious Diseases intends to procure a one year maintenance service contract from BD Biosciences to maintain the following (a) FACScans- s/n 8352,82000; (b) FACSCaliburs-s/n E0761, E5793;(c)BD LSRII-s/n 337813;(d) Hene Laser-s/n 334113;(e) Violet laser-s/n332992 and FACARIA Flow Cytometer 3 Laser System-s/n P99900014. The maintenance contract must consist of the following requirements: (1) on-site repair,(s) covers all parts require for the repair(excluding consumables),(3) labor,(4) travel expenses,(5) two preventive maintenance inspections,(60 two PM kits,(7) software revisions,(8) unlimited service visits. The contractor parts and accessories must be compatible with all systems. Any other parts used may defect the equipment and void any existing warranties. Contractor maintenance agreement is for one year. This is a firm fixed-price contract and the FOB term is ?Origin? and Payment Net 30 days. FAR provisions and clauses that apply to this acquisition: FAR 52.212-1, Instructions to Offerors, Commercial Items; FAR 52.212-3, Offeror Representations and Certifications-Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders, Commercial Items; FAR 52.225-1, Buy American Act-Supplies; FAR 52.204-7, Central Contractor Registration; and FAR 32.703-2, Availability of Funds, FAR 52.232-34, Payment by Electronic Funds Transfer-Other than Central Contractor Registration. In order to be considered for an award, an offeror must have completed the online electronic Representations and Certifications located at http://orca.bpn.gov/ in accordance with FAR 4.1201(a). By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR at www.ccr.gov/ prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation [Note: Lack of registration in the Central Contractor Registration will make an offeror ineligible for award.] Offers must be submitted no later than 5:00 P.M. Eastern Standard Time on Monday, December 29,2008.
