- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Request for Proposal (RFP) number W25G1V-09-R-0008 applies. Simplified acquisition procedures at FAR Part 13.5 are being used. This document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular Fac 2005-28. NAICS 334515, criteria of 500 employees. Tobyhanna Army Depot intends to negotiate on a sole source basis with ViaSat, Inc., 6155 El Camino Real, Carlsbad, CA 92009-1699 for the following: Contract Line Item (CLIN) 0001: Furnish and deliver test fixtures, software/firmware, fault isolation procedures, test procedures, packaging instructions, and design documentation to Tobyhanna Army Depot (TYAD) and provide all hardware, software, cables, interconnects or fixtures, and spare parts necessary for the repair of the KG-250 high-speed IP network encryptor with foreign interoperability and programmable information assurance. Equipment with calibration requirements to be delivered with certificate/sticker certifying operational performance for no less than a one-year period. Support to include four (4) months of telephone/e-mail support at eight (8) hours per month. Provide production software version changes and a full warranty for a minimum of one year on all hardware used for the KG-250 repair and all ancillary parts. Acceptance and Delivery: FOB Destination, Tobyhanna Army Depot (TYAD), Tobyhanna, PA Delivery is 30 days after receipt of award. ViaSat, Inc. designed and manufactured the KG-250 system and holds specific proprietary rights. ViaSat is the only known source capable of providing the items. There is no competitive technical data package available. However, any firms believing that they can provide the required supplies should contact the Contract Specialist identified. Proposal Requirements: Pricing must be provided for CLIN 0001. Offerors must address delivery and warranty requirements. Parties interested in responding to RFP are requested to complete a Standard Form (SF)1449 (available at http://www.forms.gov ), blocks 5, 12, 17a, 17b (as appropriate), 19 thru 24, 30a, b, and c; the offer must be signed by a company official authorized to contractually bind the company. Proposals shall include the completed full text provision FAR 52.209-5, Certification Regarding Responsibility Matters, FAR 52.212-3 ALT I (Offeror Representations and Certifications --Commercial services), completely filled out, as well as DFARS 252.212-7000, Offeror Representations and Certifications-Commercial services). Alternatively, a signed, scanned SF1449 can be sent electronically to jane.allardyce@us.army.mil. The offer shall be submitted to be received by 09 JANUARY 2009 @ 3:00 P.M. Technical proposals must show the offerors understanding of the requirement and must include: the specific items and services that the offeror proposes to provide in order to satisfy the requirement; any Government Furnished Equipment (GFE) or Property (GFP) required for the performance of the contract; and acceptance of the required delivery. For past performance, the offeror is to submit three (3) examples of the same or similar efforts which have been performed within the past three years, preferably for Government customers, but also for commercial customers. Each example should include: date of the contract; amount of the award; a brief description of the work/supplies performed/provided; and a customer Point of Contact (POC) with a confirmed valid telephone number. The following factors shall be used to evaluate offers: Technical will be pass/fail based on review of technical information submitted by offeror; past performance will be reviewed as to relevancy and quality of product and related services; and price. Although past performance is a valid discriminator, price and past performance will be evaluated as being approximately equal. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
