- The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Perkin Elmer, of Shelton, Connecticut for the purchase of a Universal Reflectance Accessory as an upgrade for NIST’s existing Lambda 950 UV-Visible-NIR Spectrophotometer under other than full and open competition by the authority of FAR subpart 13.106 b(1): Only one responsible source and no other supplies or services will satisfy agency requirements. The NIST Materials Science and Engineering Laboratory requires a Universal Reflectance Accessory as an upgrade for its existing Perkin Elmer Lambda 950 UV-Visible-NIR Spectrophotometer. To cover the entire excitation range (185 nm to 3300 nm) of the existing Perkin Elmer Lambda 950 UV-Visible-NIR Spectrophotometer, NIST requires a Universal Reflectance Accessory which is a direct upgrade for the existing spectrophotometer. This coverage of the entire excitation range will allow for overlap in data acquisition with previously acquired FTIR spectrometers as well as ellipsometers. The Universal Reflectance Accessory is designed to interchange directly with the other detector modules previously purchased for the Perkin Elmer Lambda 950 UV-Visible-NIR Spectrophotometer, and is automatically detected and controllable by the current software system. The current software system will also perform automatic calibration and detector changes for the URA. Perkin Elmer has developed this upgrade technology and has proprietary rights to that technology. The existing equipment and technology are also proprietary to Perkin Elmer. Perkin Elmer has no authorized distributors for this equipment. Perkin Elmer is thus the sole provider of this upgrade. Delivery shall be FOB Destination, Gaithersburg, MD, and be completed in accordance with the Contractor’s commercial schedule. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 3:00 p.m. (EST) on January 20, 2009. Inquiries will only be accepted via email to paula.wilkison@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
