- NOTICE OF INTENT TO ENTER INTO SOLE-SOURCE NEGOTIATIONS This notice will appear for fifteen (15) days from the date above, pursuant to FAR 5.203(a). The U.S. Geological Survey, Western Region Branch of Acquisition and Grants (USGS), intends to enter into sole-source negotiations to noncompetitively increase the ordering ceiling of indefinite-delivery, indefinite-quantity contract 06WRCN0005 to CLS America, Inc. (CLS), of Largo, MD which provides for Argos satellite data collection and transmission services. Argos is a satellite-based data collection and geo-location system which is increasingly used by the USGS to track the movement of migratory wildlife (migratory birds and polar bears are common applications). A small satellite transmitter (called a platform transmitter terminal, or PTT (sometimes colloquially referred to as a platform telemetry transmitter)) is affixed to the animal of interest and beams either a Doppler-based or GPS-based signal through the Argos satellite system, tracking the location of the animal with an accuracy of (up to) several meters. Due to the increasing research focus on climate change, which bears on polar bears as related to sea ice loss, and the concern over avian influenza, which bears on migratory birds as an intercontinental disease vector, the USGS has been deploying more PTTs in the past several years than ever before. Each active PTT incurs data transmission charges through the Argos system. The Argos system has been operational since 1978. It was established under an agreement between the National Oceanic and Atmospheric Administration (NOAA), the National Aeronautic and Space Administration (NASA) and the French NASA-equivalent, the Centre National d'Etudes Spatiales (CNES). Japan, the European Union, and India have since joined the Argos system via decisions to fly Argos equipment on their satellites. In 1986, CNES created a subsidiary, the Collecte Localisation Satellites (CLS), to operate, maintain, and commercialize the Argos system. Also in 1986, Service Argos, Inc. and North American CLS were created to service North American customers. In 2006, those two companies merged to form CLS America, Inc., the single company that can provide access to the Argos system for North American users. For North American customers, such as the USGS, the only access to the Argos system, which is critical to the success of the USGS telemetry program, is through CLS America, Inc. This notification is provided to the public because this proposed modification is considered a "contract action" in accordance with FAR 5.001, as an "action(s) for additional supplies or services outside the existing contract scope" which requires synopsis. For the reasons discussed above, the USGS intends to enter into sole-source negotiations with CLS in accordance with FAR 6.302-1, only one responsible source. In accordance with FAR 5.207(15)(ii), any other responsible sources may submit a capabilities statement or proposal which will be considered by the USGS, provided it is submitted by the closing date of this announcement. This announcement and any resulting modification conform to the requirements in place through FAC 2005-28, effective 12 December 2008.
