DESCRIPTION/SPECIFICATIONS/WORK STATEMENT FOR AREA MOWING AND FACILITY MOWING SERVICES AT BENBROOK LAKE _____________ PART 1. GENERAL 1.1 SCOPE OF WORK - Contractor shall provide all contract work force and equipment required to perform specified Area mowing and Facility Mowing services at Benbrook Lake Project. Contractor's work and responsibility shall include, but not be limited to, all job planning, programming, scheduling, administration, inspection, and management necessary to accomplish the required specified services. Contractor shall assure that all work is accomplished in accordance with the contract, all applicable laws, municipal codes, regulations and/or written directives issued by the Contracting Officer. 1.2 INTENT - This is a service type contract for providing personnel, equipment, vehicles, fuel, materials, supplies, supervision, and quality control necessary to perform recreational mowing in two (2) categories defined herein as (1) Area Mowing and (2) Facility Mowing, all within the boundaries of Benbrook Lake. 1.3 PROJECT DESCRIPTIONS AND INFORMATION : 1.3.1 LOCATION - 1.3.1.1 BENBROOK LAKE : Benbrook Lake is located entirely in Tarrant County. The Project Headquarters is located at 7001 Lakeside Dr., Forth Worth, Texas 76126-0619, office phone 817.292.2400. The lake is generally bounded on the west by Hwy 377, by FM 1187 on the South, Old Granbury Road on the East, and by Lakeside Drive on the North. Office hours are from 7:30 a.m. to 4:00 p.m. Monday thru Friday. 1.3.2 CLIMATE - 1.3.2.1 BENBROOK LAKE : The climate in Tarrant County, Texas is generally mild with hot summers and cool winters. Extreme temperatures, snowfall, rainfall, and drought conditions are experienced regularly. Recorded temperatures range from a maximum of 108 degrees Fahrenheit to a minimum of minus 4 degrees Fahrenheit, with a mean annual temperature of 65 degrees Fahrenheit. The average length of an annual growing season is 230 days. Annual mean precipitation is 31.3 inches. 1.3.3 SOIL CONDITIONS - 1.3.3.1 BENBROOK LAKE : Project has varying types of ground and soil conditions. The land is characterized by gently rolling hills interspersed by more rugged slopes and small bluffs. Soils types are predominately loam and clay, with sands comprising the remaining portion. 1.4 WORK COVERAGE - The work will consist of furnishing all labor, materials, and equipment necessary to perform specified area mowing and facility mowing services, at Benbrook Lake. The areas covered, number of facilities, and frequencies for all required services are provided in List of Attachments, listed as Tabulation of Estimated Work Requirements. 1.5 FREQUENCY OF SERVICE - It may become necessary at any time during the duration of this contract for the Contracting Officer to close any park or portion of a park and delete any subsequent service for the closed park or area. The number of mows actually required during the contract period may be above or below the estimated number due to the prevailing rainfall in the area. No adjustment of the unit price shall be made for any variation from the estimate. 1.6 WORKDAY - Normal working hours for the contractor shall be between the hours of 7:00 a.m. to 7:30 p.m., Monday thru Friday, except as specifically approved in advance by the COR. Major Federal Holidays during the recreation season (1 April - 30 Sept) shall be observed by the contractor and no work on the site shall be permitted except in extreme cases and after specific approval by the COR (NOTE: The Contractor may, with the COR's prior approval, be allowed to mow the embankment on weekends and/or holidays). See PART 9 for major Federal Holidays and check with Project Office for specific day that Holidays are observed each year. 1.7 TYPICAL UNIT DRAWINGS - Specification requirements shall override all typical drawings. Typical drawings are not to scale, nor are they intended to depict all facilities. Each unit varies considerably in structure, design, and size. Therefore, typical drawings are included for general information purposes only in List of Attachments. 1.8 PERMITS - The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses, permits, and letters of certification. The Contractor shall comply with any applicable Federal, State, County, and Municipal laws, codes, and regulations in connection with the performance of the work specified under this contract. 1.9 AWARD OF OTHER CONTRACTS - The services provided under this contract shall be independent of all services provided under other contracts, at this project or any other project, at which the Contractor may receive award. 1.10 SAFETY REQUIREMENTS - Contractor shall develop and submit a written detailed Accident Prevention Plan within fifteen (15) days after award and prior to beginning work (See Contract Clause entitled "Accident Prevention"). This plan must indicate in detail the general policies and procedures for safe operation in the accomplishment of this contract. The plan shall include an "Activity Hazard Analysis" as defined in Section 01.A.09 of Safety Manual stated below. The Safety Plan and Hazard Analysis shall show how the Contractor intends to perform services in full compliance with the safety requirements set forth in the most current EM 385-1-1, entitled Safety and Health Requirements Manual, copies of which are available at Benbrook Lake Project Office or on the Corps of Engineers web page at http://www.swf.usace.army.mil/safety/contract.htm. PART 2. DEFINITIONS 2.1 GENERAL - For this contract the following terms shall relate as follows: 2.1.1 PROJECT - Means Benbrook Lake and related features. 2.1.2 GOVERNMENT - Means the Government of the United States of America. 2.1.3 CONTRACTING OFFICER - Means the person executing this contract on behalf of the Government and includes the Contracting Officer's Representative (COR). 2.1.4 CONTRACTING OFFICER REPRESENTATIVE (COR) - Means the person authorized in writing as the Contracting Officer's Representative, acting within the limits of their authority. 2.1.5 CONTRACTOR - Means the company structure, including all partners, officers, and employees with interest in this contract. 2.1.6 ORDERING OFFICER - Means the person or persons identified in the solicitation as authorized to issue delivery orders 2.1.7 QAR - Acronym for Quality Assurance Representative - Personnel that will perform inspections of Contractors work and will have the first line of contact with the Contractors Quality Control Inspector. The QAR represents and presents inspection and contractual problems to the COR. 2.1.8 QUALITY ASSURANCE SURVEILLANCE PLAN (QASP) - A Quality Assurance Surveillance Plan is a plan developed by the Government depicting how Quality Assurance shall be controlled. 2.1.9 DELIVERY ORDERS - Mowing services to be furnished under this contract shall be ordered on a document referred to as a delivery order. The Ordering Officer shall issue these orders. All delivery orders are subject to the terms and conditions of the contract. In the event of conflict between a delivery order and this contract, the contract shall control. If mailed, a delivery order is considered issued when the Government deposits the order in the mail. 2.1.10 QUALITY CONTROL - The term Quality Control refers to action taken by the Contractor and/or their personnel to document, inspect, and control performance of mowing services to insure they meet the specifications and requirements of this contract. 2.1.11 QUALITY ASSURANCE - The term Quality Assurance refers to action taken by the Government to insure the Contractor's quality control system is functioning and effective and that the Contractor is providing services which are in accordance with this contract. 2.1.12 CONTRACT DEFICIENCY REPORT (C.D.R.) - The Contract Deficiency Report is a written record of unsatisfactory performance by the Contractor as observed by the Quality Assurance Inspector. PART 3. FACILITIES AND EQUIPMENT 3.1 EQUIPMENT STORAGE - Equipment may be parked on site only in area designated as shown on the maps attached as part of List of Attachments or areas designated by COR. No equipment or supplies shall be stored inside compound at Benbrook Headquarters. The Government shall not be held liable for any damages received while on Government Property. 3.2 POINT OF CONTACT REQUIREMENTS - The Contractor shall provide to the COR a local telephone number and a point of contact on a twenty-four (24) hour basis for discussion of any contractual matters. 3.3 COMMUNICATION - The Contractor and/or Quality Control Inspector is required to have a mobile cellular telephone with electronic mailbox for communication purposes with Government personnel under this contract. Messages left in the electronic mailbox from the COR or QAR must be responded to within two (2) hours during the workday, within twenty-four (24) hours on a non-work day. The Contractor and/or Quality Control Inspector shall check voice mail messages on a routine basis during each workday. Also, the work leader of each work crew shall have a mobile cellular telephone for safety and communication purposes. Phone numbers for all required mobile cellular telephones shall be submitted to Project Office prior to starting work. 3.4 GOVERNMENT FURNISHED SUPPLIES AND MATERIALS - The Government shall not furnish any labor, equipment, fuel, supplies or materials under this contract. 3.5 DAMAGE TO GOVERNMENT AND PRIVATE PROPERTY - The Contractor shall be responsible for restoring any Government property damaged as a result of their operation. Contractor shall also be responsible for any damage to private property and injury to any person as a result of their operation. The Contractor shall notify the COR immediately of damage to Government or private property, or injury to any person resulting from their operation. Contractor shall be charged for damage at replacement or repair cost (i.e., damaged trees, rutting, signs, post, electrical facilities, water risers, etc.). The Contractor shall cooperate with Government personnel in safeguarding public property. The Contractor shall be responsible for reporting acts of vandalism, larceny, or pilferage to the COR as part of the Contractor's quality control reports. 3.6 EQUIPMENT 3.6.1 GENERAL - The Contractor shall furnish equipment necessary to accomplish all of the work required by this contract within the time frames specified. All equipment shall be presented to the COR for approval prior to commencement of services to ensure compliance with specifications. 3.6.2 CONDITION OF EQUIPMENT - All equipment used to perform work under this contract must be in good operating and mechanical condition and comply with EM 385-1-1, Corps of Engineers Safety and Health Requirements. A regular schedule of preventive maintenance must be followed on all equipment. 3.6.3 EQUIPMENT REQUIREMENTS - All equipment must be operated in such a manner as too not cause damage to government property or property of others. All equipment such as tractors, tractor mowers, and small riding mowers utilized in the performance of this contract shall be in full compliance with EM 385-1-1, Corps of Engineers Safety and Health Requirements, Section 16, titled Machinery and Mechanized Equipment, concerning rollover protection (ROPS), seat belts, back up alarms, safety guards, and other required safety equipment and practices. Blades shall be kept sharp and are subject to inspection by the COR at any time. One (1) 2-1/2 pound A:B:C dry chemical fire extinguisher shall be required on all tractors and mowers capable of being ridden. 3.6.3.1 EQUIPMENT FOR AREA MOWING - Where possible, mowing shall be done with rubber tired tractors with a tractor mounted rotary, flail-type mowers or side mounted hydraulic boom-mounted mowers. The mowers must be equipped with safety chains or other protective devices to prevent flying stones, cans, etc., from striking persons (including tractor operator) or damaging property. Mowers must have wheels, which will prevent tearing or plowing into the turf. Contractor may be held accountable for re-turfing if equipment causes gouging or plowing. In areas where it is not possible to use a tractor-mounted mower, the Contractor shall use small mowing equipment such as lawn and garden tractors, push mowers, line trimmers, and other small power-mowing equipment, and/or manual mowing tools such as a sickle. Contractor shall use all approved means to perform mowing requirements in designated areas. 3.6.3.2 EQUIPMENT FOR FACILITY MOWING - Self-propelled, rubber-tired lawn riding mowers less than thirty-two (32) horsepower and push mowers are the only type mowers authorized. Mowers shall provide a close (not more than 3" & not less than 1.5") and even cut. 3.6.3.3 EQUIPMENT FOR EMBANKMENT MOWING - Contractor is required to use a tractor equipped with dual rear wheels to mow the top portion of the Embankment (steeper part, between the levee and access road of the Embankment). 3.6.3.4 EQUIPMENT FOR TRIMMING - Equipment used for trimming shall be either powered or manually-operated, and adequate to provide close trimming. 3.6.3.5 EQUIPMENT FOR EDGING - Edgers shall be either gasoline or electrically operated. Edgers shall be equipped with a metal edge to eliminate blade contact with concrete walks, curbs, etc. 3.6.4 EQUIPMENT SAFETY INSPECTIONS - The Contractor shall present all equipment to the COR or designee as outlined in the EM 385-1-1, Corps of Engineers Safety and Health Requirements, Section 16, for inspection whenever equipment is brought to the project, especially prior to each mowing. The Contractor shall notify the COR at least two (2) days prior to bringing equipment on site so that the time and place of these inspections may be scheduled. No equipment shall be used on the project prior to passing inspection. The COR may inspect equipment at any time it is operated on Government property. Any equipment found deficient shall be taken out of service immediately until faulty conditions have been corrected and passed by the COR. 3.7 VEHICLES 3.7.1 All vehicles utilized under this contract will be presentable, serviceable, and shall comply with safety standards as required by the State of Texas. 3.7.2 All Contractor vehicles utilized under this contract shall be identified with professionally made door signs which include the Contractor's name, address, and phone number in letters one-inch (1") or larger. Door signs shall be on both sides of each vehicle. Professionally done hand lettering, magnetic signs, or pressure sensitive decals shall be used to comply with this specification. 3.7.3 Off-road travel by vehicles (other than tractors) will be limited to that necessary for loading, unloading and repair work. 3.7.4 All vehicles utilized in the performance of this contract shall be in full compliance with EM 385-1-1, Corps of Engineers Safety and Health Requirements, Section 18. PART 4. PERSONNEL 4.1 MINIMUM MANPOWER REQUIREMENTS - The Contractor shall provide an adequate number of fully qualified personnel to perform the specified services properly and efficiently within the time limits specified. All personnel shall be in full compliance with EM 385-1-1, Corps of Engineers Safety and Health Requirements, Section 5, titled "Personal Protective and Safety Equipment". 4.2 EMPLOYEE CONDUCT - The Contractor shall be responsible for seeing that all employees strictly comply with all Federal, State, and Municipal laws. Any illegal or criminal activity may result in the removal of Contractor employee/employees and/or termination of the contract. 4.3 REMOVAL OF CONTRACTOR'S EMPLOYEES - The Contracting Officer or the COR may require the Contractor to immediately remove from the work site any employee of the Contractor or subcontractor, who, in the opinion of the COR, is incompetent, who endangers persons or property, or whose physical or mental condition is such that it would impair the employee's ability to satisfactorily perform their work. Notification to the Contractor shall be promptly made in writing if time and circumstances permit. Otherwise, notification shall be verbal or telephonic, and shall be confirmed in writing as soon as possible. No such removal, however, will reduce the Contractor's obligation to perform all work required under this contract, and immediate replacement will be made as required. This requirement shall not be made the basis of any claim for compensation or damages against the United States or any of its officers or agents. 4.4 SUPERVISION - The Contractor shall give their personal superintendence to this contract. Contractor shall appoint in writing, subject to the approval of the COR, a minimum of one (1) Superintendent for Benbrook Lake. The Superintendent shall be present whenever work specified herein is being performed, and have full authority and power to act for the Contractor on items pertaining to overall work performance, management, coordination, and supervision. The Superintendent shall have means of transportation and communication at all times while work activities are being performed. This individual may also serve as the Quality Control Inspector, provided that their job performance in each category is maintained at an acceptable level to the COR. The Superintendent and/or quality control personnel shall be required to have a copy of the contract in their possession at all times for referral concerning questions of Contractor responsibility. In addition, the Contractor shall designate a responsible employee on each work crew, to act as work leader, and to complete a daily activity report. 4.5 QUALITY CONTROL - The Prime Contractor is responsible for insuring that all work performed under this contract, including that performed by subcontractors, is in accordance with the specifications. To accomplish this, the Prime Contractor shall appoint in writing, subject to the approval of the COR, one (1) Quality Control Inspector. Requirements for Quality Control shall be set forth in Part 5. Inspections. PART 5. INSPECTIONS 5.1 GENERAL - The Government shall inspect the work in each area as it is completed to ensure all requirements of the contract have been satisfied. The Contractor shall be responsible for ensuring all work is completed prior to inspection by the government. 5.2 CONTRACTOR QUALITY CONTROL - The Contractor is responsible for establishing and maintaining an adequate quality control system to satisfactorily inspect and ensure that all work performed by the Contractor's organization in each separate service is in full compliance with this contract and the instructions, provisions, specifications, and maps herein. The Contractor shall designate, in writing, a Quality Control Inspector, whose main duty shall be limited to verifying contract conformance of all work performed daily and maintaining daily activity. Duties of Quality Control Inspector shall also include reviewing each work leader's daily activity report to ensure that it is legible, understandable, and complete, and to notify the COR of anything requiring immediate attention. The COR may request additional quality control personnel at any time he or she feels that the Contractor's work is in danger of nonconformance, at no additional cost to the Government. The Quality Control Inspector may also be appointed Job Superintendent, see Section 4.5. 5.2.1 The Contractor and/or Quality Control Inspector shall survey the park or area and report all damage or vandalism to the COR prior to commencement of mowing or trimming in each area. Any damage found thereafter by the Governments inspector, that has not been previously reported by the contractor, shall be assumed to be damage caused by the Contractors operation, and shall be repaired, replaced, or deducted from the contractor's invoice, as determined by the COR, at no cost to the Government. 5.2.2. Quality Control Report - A Quality Control Report indicating daily activities, shall be submitted for the COR's approval by 0830 a.m. of the next working day. This report shall include (but not limited to) the following: 1. Name of Quality Control Inspector 9. Corrective actions taken 2. Lake 10. Safety Issues 3. Park 11. List of damaged property 4. Date 12. Any facilities and/or areas closed 5. Weather 13. Facilities & areas not mowed and reason why 6. Time Started / Time Stopped 14. List of all personnel and equipment 7. List of areas inspected 8. Deficiencies encountered 5.3 CONTRACTOR QUALITY CONTROL PLAN - The Government shall monitor and inspect the Contractors operation to ensure that the Quality Control is in place and is working, and that the Contractors performance meets all contract specifications. 5.4 GOVERNMENT QUALITY ASSURANCE - The Government shall monitor the Contractors service performance using the 100% Inspection (by park; and/or area) Method, as described in Part 8. QUALITY ASSURANCE SURVEILLANCE PLAN, (QASP). Note part 8.1.3 of the QASP under 100% Inspection concerning re-inspection by the Quality Assurance Inspector. (Also reference Section E, Inspection of Services) 5.5 INSPECTION OF EQUIPMENT AND SUPPLIES - The COR may inspect required equipment and supplies at any time when in use on Government property. Any individual, crew, or equipment found deficient shall be removed from service immediately until faulty conditions have been corrected and passed by the COR. No such removal shall reduce the Contractor's obligation to perform all work required within the time scheduled under this contract. This requirement shall not be made the basis of any claim for compensation or damages against the United States or any of its officers or agents. 5.6 CONTRACTOR PERFORMANCE DEFECTS, DEFICIENCIES, AND REPERFORMANCE - Deductions for defects and deficiencies in Contractor performance, and reperformance of same, shall be in accordance with the "Deductions" paragraph addressed in the QASP. However, the Government reserves the right to use Contract Clause entitled "Inspection of Services" for this purpose in lieu of the "Deductions" paragraph. 5.7 PERFORMANCE EVALUATION MEETINGS - The Contractor, Superintendent, Quality Control Inspector, or all, shall meet with the COR, or designated representative, periodically as determined necessary by the COR, in order to discuss performance. However, a meeting shall be held not later than one normal workday after a Contract Deficiency Report (CDR) is issued. Mutual effort shall be made to resolve any and all problems identified. PART 6. MOWING SERVICES SPECIFICATIONS 6.1 SCOPE OF WORK - The work shall consist of furnishing all labor, material, and equipment necessary to perform AREA and FACILITY mowing according to the following requirements at the locations as indicated by appropriate limits on the attached park maps in List of Attachments. Mowing SHALL NOT take place close enough to facilities to cause damage. 6.1.1 REQUIREMENTS FOR AREA MOWING - Contractor shall mow and trim grass, weeds, tree and brush sprouts (including woody pulp and brush sprouts which may or may not have been cut within the last three (3) years) in the public use areas to the waters edge (regardless of pool elevation or vegetative growth) and along access roads. Unless indicated otherwise on the attached park maps, area mowing shall be performed over a distance of: a) Fifty-Feet (50') on each side of access roads. b) Fifty-Feet (50') beyond limits of parking areas. c) Fifty-Feet (50') beyond paved edges of boat ramps and boat ramp turnarounds or to the tree line if it falls within the required fifty feet (50') distance. d) Twenty-feet (20') path on the Embankment top. e) Fifteen-feet (15') path along fence on Property Line f) Eight-feet (8') path over the Horse Trail in Holiday Park and Clear Fork. Location of Horse Trail is attached as part of List of Attachments. 6.1.1.1 The required fifty-foot (50') distance includes ditches, back slopes, and bluff areas which can be cut with power equipment, side mounted hydraulic boom mowers, hand tools or any equipment necessary to perform the above task. 6.1.1.2 Vegetation shall be cut to a height of not more than four-inches (4") or less than two-inches (2") above ground. Mowing equipment must be operated in a manner that will prevent the tractor wheels or mower from tearing out turf on turns. Each pass of the mower shall overlap the previous pass so that no strips of uncut vegetation will result. If, for any reason, strips of uncut vegetation are visible in the mowed area, the strips shall be re-mowed, even though it may be several days before the strips are visible. Mowing shall not be permitted when the ground is so wet or boggy that the mowing operations will cause wheel rutting. 6.1.1.3 Contractor shall be required to remove by the end of each work day all grass, rocks, crushed limestone, brush, branches, etc. that are thrown onto the road surfaces as a result of mowing operations. 6.1.1.4 Mowing with a tractor-mounted mower shall not be permitted within a distance of five-feet (5') of an electrical pedestal at camp sites, electrical distribution panels, pad mounted electrical transformers, lighted signs, water faucets, pay phones, park entrance signs, traffic counters, and horse shoe courts. Mowing with a tractor-mounted mower shall not be permitted within any area designated for Facility Mowing. Mowing with tractor-mounted mowers shall be permitted near road and facility signs, guard post and rails, trees, shrubs, and culverts, providing such mowing are performed in such a manner that these items shall not be damaged in any way. Mowing with tractor-mounted or towed mowers shall be permitted parallel to sidewalks, but under no circumstances are they allowed to cross sidewalks. Signs, traffic delineators, guard post and rails, sewer stub outs, sewer clean-outs, water valve meter boxes and associated plumbing, trees, shrubs, sidewalks, asphalt pavement and culverts damaged by Contractor activity, shall be repaired or replaced as determined by the Contracting Officer at no cost to the Government. Traffic control rocks, pipe fence and/or posts, signs, angle iron sign supports, etc. moved out of alignment by the Contractor shall be realigned by the Contractor at no cost to the Government. 6.1.1.5 Clusters of wildflowers such as Bluebonnets and Indian Paintbrushes with a diameter greater than ten-feet (10'), and with a density of at least fifty percent (50%) shall remain un-mowed until seed pods have begun to dry. The COR shall inform the Contractor prior to each partial mowing of the areas affected by this requirement. 6.1.1.6 The Government is not responsible for the condition of the mowing area (grass height, rocks, trash, debris, etc.) at the time the contract becomes effective. 6.1.1.7 After tractor operations in one park area is completed, tractors may proceed to the next park area for mowing, while trimming and other non-tractor operations continue in the first park. All mowing and trimming operations of any nature must be completed and inspected by the end of the following day. If all remaining work has not been completed and inspected within the one (1) day period, then all tractor mowing must stop until work crews have completed the last mow area. Contractor shall notify the COR immediately upon completion of an area to allow for timely inspection. 6.1.2 REQUIREMENTS FOR FACILITY MOWING - Facilities to be mowed are tabulated in the attached TABULATION OF PARK AREAS & FACILITIES which is in the List of Attachments. Unless indicated otherwise on the attached park maps, facility mowing shall be performed over a distance of: a) Twenty-five-Feet (25') around waterborne and vault toilets, single table sites, volleyball courts, and screen shelters. b) Twenty-five-feet (25') around automatic electric gates located at Dam. c) Fifteen-Feet (15') around refuse containers, drinking fountains, water well houses, and bird blind. d) Fifteen-Feet (15') along both sides of hunting gates and adjoining pipe fence. e) Mowing at trailer sewage dump stations shall include a fifteen-foot (15') strip around the outside perimeter (all shrubs shall be included in perimeter) and all area inside the drive loop. f) Ten Feet (10') wide strip along both sides of parking pads at single table sites. g) Note attached maps for mowing areas around park Entrance Booths, Gate Attendant Sites, and Volunteer Sites. 6.1.2.1 Contractor shall be required to mow and trim vegetation, in the required area around these facilities, to a height of not more than three-inches (3") or less than one and one-half inches (1-1/2"). If a facility is occupied at the time of the scheduled mowing, the Contractor shall request permission from the occupants to mow the facility. If permission is not granted, the Contractor shall immediately record the unit on a written list of un-serviced units. If the facility becomes unoccupied while the Contractor is still in the park, it shall be mowed as required and removed from the list. A listing of all un-serviced facilities and the reason for non-service shall be included as part of the daily QC Inspection reports turned in by the Contractor to the COR. If mowing of a facility is not possible due to site occupancy during the mowing of the rest of the park area, the Contractor may proceed to the next park area; however the facility shall require mowing when it becomes unoccupied, regardless of whether the Contractor is in that park or another. 6.1.2.2 Unless otherwise approved by the COR, noting the exceptions in paragraphs 6.1.2.1, all mowing and trimming within one of the individual park areas shall be completed and inspected by the Government before mowing is started in another area. Contractor shall notify the COR immediately upon completion of an area to allow for timely inspection. 6.1.3 REQUIREMENTS FOR EMBANKMENT MOWING - 6.1.3.1 Contractor shall mow a twelve-foot (12') strip along the outside of the chain link fence each time the Embankment is mowed. 6.1.3.2 Contractor shall trim chain link fence line each time the Embankment is mowed. 6.1.3.3 The Contractor shall exercise EXTREME caution to insure that no damage is done to piezometer when mowing the Embankment. 6.1.4 REQUIREMENTS FOR MOWING PROPERTY LINE - 6.1.4.1 Contractor shall mow a fifteen-foot (15') strip along Government property line. Contractor shall make note on the Quality Control Report of any damaged or cut wires that would create openings in fence line. 6.1.5 REQUIREMENTS FOR TRIMMING - Contractor shall be required to do trimming with small power equipment and/or hand tools, around all vertical objects within the mowed area, such as buildings, water storage tanks, sign posts, guard posts and pipe rail supports, guard rails, tables, trash containers, electrical outlet pedestals, water faucets and fountains, cookers, traffic counters, trees, shrubs, rocks, culverts, and any other natural or manmade objects that protrude above the ground line to such a height as to prevent passage of the larger mowing equipment over them without damage to the equipment or the object. Trimming and/or edging shall be done along all sidewalks, table slabs, etc. to ensure that vegetation does not overlie the walking area. Trailer sewer hoses shall be moved or covered to prevent damage during trimming operation. 6.1.5.1 Powered string trimmers shall not be used to trim within twelve-inches (12") of saplings/trees that are less than three-inches (3") in diameter at a height of four and one-half feet (4-1/2') above ground level. Contractor shall be required to pay for or replace any damaged saplings/trees as described in PART 7. DAMAGE RESPONSIBILITY. 6.1.5.2 Contractor shall trim shrubs located at dump stations and rest rooms. Shrubs at dump stations shall be trimmed and maintained to a maximum height of five-feet (5') and a diameter of four-feet (4'). Shrubs located at rest rooms shall be trimmed to a maximum height of five-feet (5') with a maximum width of three-feet (3'). Shrubs shall not be allowed to overhang sidewalks. Shrubs shall be trimmed each time the facility is mowed. Contractor shall also be required to trim inside fence area at water storage tanks. 6.1.5.3 All loose grass, dirt, rocks, etc., shall be removed from slabs, sidewalks, table sites, trailer parking pads, and from inside rest rooms after mowing, trimming and edging operations. 6.1.5.4 Vegetation shall be cut to the height of not more than four-inches (4"), nor less than two-inches (2"). Work in these areas shall be accomplished in a manner that shall preserve and encourage the growth of grasses, and chopping vegetation at or below ground level shall not be permitted. 6.1.5.5 Woody vegetation within the mowing limits obstructing drainage into or out of culvert head walls, or growing on the edges of concrete drains, gabions, or paved road surfaces shall be cut at ground level. 6.1.5.6 The Government reserves the right at any time to plant additional trees and/or shrubs in any park or area which shall require trimming as described above at no additional cost to the Government. 6.1.6 REQUIREMENTS FOR EDGING - Contractor shall be required to edge the curb along Winscott Road (approx. 1800 LF) in Dutch Branch Park and also along access road to boat ramp (approx. 900 LF) in Longhorn Park. Curbs shall be edged each time AREA MOWING is performed in this park. 6.2 DELIVERY ORDER - Mowing shall be accomplished when directed in writing by the Ordering Officer. This directive shall be in the form of a delivery order authorizing the Contractor to mow any one or more of the designated areas. The delivery order shall also state the number and sequence in which the parks or areas are to be mowed and the time limitation allowed. 6.3 TIME LIMITATION - The Contractor shall be allowed a specified number of working days, (exclusive of Saturdays, Sundays and Federal Holidays) to accomplish the mowing. All work shall be started within five (5) working days after notification. The starting and completion dates are critical in the performance of this contract. If work cannot be commenced on the starting date, the Contractor shall provide written notification to the COR and submit for COR approval a revised schedule. Delays in service requiring an extension to the completion date due to inclement weather or conditions beyond the Contractor's control may only be allowed with the approval of the COR. If the Contractor does not complete the required mowing within the time specified on the delivery order, without sufficient cause, deductions may occur; and/or termination. 6.3.1 AREA MOWING - Area mowing shall be completed within fifteen (15) working days for all parks, which includes nature trail, horse trail, top of the embankment, and the first partial mowing. 6.3.2 FACILITY MOWING - Facility mowing shall be completed within five (5) working days. 6.3.3 EMBANKMENT MOWING - Embankment mowing shall be completed within five (5) working days. 6.4 MOWING FREQUENCY - Each mowing shall be directed in writing by a Task Order. The Government reserves the right to request mowing in selected parks, areas, and/or facilities if growth of vegetation warrants. The estimated number of mows is as shown in the bid schedule. 6.4.1 AREA MOWING - A minimum of one (1) and a maximum of eight (8) delivery orders, each year, may be required by this contract, based on need. The estimated number of mowings is five (5) per year unless otherwise stated on bid sheet. 6.4.2 FACILITY MOWING - The combined total number of Summer Season and Winter Season mowings is estimated to be twenty (20) per year. 6.4.2.1 SUMMER SEASONS (March thru October) - A minimum of one (1) and a maximum of twenty-four (24) mowings. The estimated number of mows is sixteen (16) per season. 6.4.2.2 WINTER SEASONS (November thru February) - A minimum of one (1) and a maximum of eight (8) mowings. The estimated number of mows is four (4) per season. 6.4.3 EMBANKMENT MOWING - It is estimated that two (2) mowings of the Embankment shall be required. It is anticipated that the first mowing shall be performed in the Spring and the second mowing shall be performed in the Fall. 6.5 MAPS - Maps for the areas in which the work will be accomplished are attached in List of Attachments and indicate the limits of the area to be mowed. NOTE: THE MAPS ATTACHED, LOCATED IN THE LIST OF ATTACHMENTS, ARE INTENDED TO REFLECT THE GENERAL MOWING BOUNDARIES FOR THE PARKS AND ARE FOR INFORMATION ONLY. FOR ACTUAL ACREAGE AND TRIMMING REQUIREMENTS, REFERENCE THE TABULATION OF ESTIMATED WORK REQUIREMENTS ALSO LOCATED IN THE LIST OF ATTACHMENTS. IT IS THE CONTRACTOR'S RESPONSIBILITY TO VISIT THE PROJECT TO INSPECT ACTUAL ON-GROUND CONDITIONS. 6.6 RESTRICTIONS - 6.6.1 The COR shall fur­nish the Contractor a list showing the sequence in which each area is to be mowed. Completion of work and the Government's Quality Assurance Inspec­tion Schedule will adhere to this sequence. In all cases the Contractor shall provide sufficient personnel and equipment to complete the work within the required time limitation. 6.6.2 No mowing operations, other than Embankment Mowing, shall be permitted on Saturdays, Sundays, or Holidays unless approved by the COR. No mowing shall be permitted after dark. 6.6.3 The Contractor shall conform to all traffic and other regulations as found in Section 327, Chapter III, Title 36 of the Code of Federal Regulations, available from the COR. Should the Contractor use a developed camp area for overnight occupancy, all applicable regulations shall be adhered to. Vehicles and trailers shall be parked in designated parking areas when not in use, and off road travel by vehicles other than tractors shall be limited to loading/unloading and repair work. 6.6.4 Keys issued to the Contractor for access to mowing areas shall be returned upon completion of each mowing. 6.7 SAFETY 6.7.1 Safety Meetings - The Contractor shall hold a safety meeting with all employees prior to each mowing, and will notify the COR of location and time of each meeting. A report of the meeting shall be made. The report shall include (but not limited to) date, location, topics covered, and signed by all employees attending the meeting. When a new employee is hired, the Contractor will thoroughly brief that person in all safety procedures and requirements. Any Contractor employee who persists in unsafe performance shall be removed from the job at the request of the COR. A copy of the safety meeting report shall be submitted to the COR prior to performing mowing and safety briefing reports for new employees shall be submitted prior to employee performing duties. PART 7. DAMAGE RESPONSIBILITY 7.1 The Contractor shall be responsible for restoring any Government facilities or structures damaged as a result of the contractor's operation. The contractor shall also be responsible for any damage to private property and injury to any person as a result of their operations. The contractor shall notify the Con­tracting Officer immediately of damage to Government and private property and injury to any person resulting from the contractor's operations. Also, the Contrac­tor shall advise the COR of damage to Government facilities due to van­dalism or other causes on the day the contractor first notices such damage. Trucks and/or trailers will be driven on existing roads only and not across or through park areas to facilities. 7.2 It shall be the Contractor's responsibility to repair any areas that may be damaged from rutting caused by equipment. 7.3 It shall be the Contractor's responsibility to repair all damages to grass and parking areas due to refueling and servicing activities, at no cost to the Government. 7.4 Damages shall be collected for trees that are injured by mowers or trimming crews. Damage shall be collected in accordance with the amounts given in Table A, Landscape Trees, and Table B, Native Trees. Injury to a tree's bark and cambium layer will be expressed as a percent of injury to the circumference of the tree. However, if more than fifty percent (50%) of the cambium, expressed in terms of circumference, is injured, the tree will be considered a total loss. Table A - Landscape Trees. Trees that have been planted or preserved to serve a specific landscape purpose such as screening, shade, flowering, fruiting, noise abatement or visual esthetics. PART 8. QUALITY ASSURANCE SURVEILLANCE PLAN 8.1 QUALITY ASSURANCE SURVEILLANCE PLAN - Payment will be based on 100 % inspection. 8.1.1 100 % INSPECTION METHOD - Surveillance by this method requires that every occurrence of a performed service be monitored. Contract requirements using these evaluations are generally those that occur infrequently, or are essential, or are costly to perform, or at the Governments discretion. These results are then compared to the specific contract requirements. 8.1.2 Mo nitoring - Inspection of all services performed under this method shall be conducted according to a schedule developed by the Government. 8.1.3 Deductions - The COR may require that all work which fails to provide the desired results be redone or reduce the contract price to equal the reduced value of the service. The Contractor will ensure that these defects do not recur. If the contractor fails to rework the rejected areas or the defects are recurring, the Government may: 8.1.3.1 Reduce the contract price to equal the reduced value of the service. 8.1.3.2 Perform the required services, by contract or otherwise, and deduct any costs incurred by the Government that is directly related to the performance of such services from the Contractors monthly invoice. 8.1.3.3 Terminate the contract for default. See Contract Clause entitled Default (Fixed-Price Supply and Service). 8.1.3.4 Deductions - The deductions taken under this method will be based on the following example: EXAMPLE: a. The contract price for mowing the yard at the Project Office under the Facility Mowing Bid Schedule is $25.00. b. The Contractor failed to mow the yard on the scheduled day, requiring the Government to hire individual to mow the yard at a cost of $25.00. c. The Delivery Order was written for a complete Facility Mowing, including the Project yard, for a total cost of $1,830.53. d. The deduction from the invoice total cost of $1,830.53, which was mirrored from the Delivery Order, is $25.00. ( $1,830.53 - $25.00 = $1,805.53 ) 8.1.3.5 Should it become necessary for the Quality Assurance inspector to perform re-inspections of defective work that was required to be redone, (due to failure of Contractor Quality Control System to locate and cure these deficiencies prior to the QA's initial inspection), there shall be a re-inspection charge. This shall be based on the Actual Government Cost at the Effective Hourly Rate for inspectors, and other administrative and overhead costs, for Park Area and Facility mowing, of $40.00 per re-inspection, per park or occurrence. These charges shall be deducted from the Contractor's monthly invoice. Deductions for re-inspection shall be taken based on the following examples: EXAMPLE: a. Re-inspection of Facility Mowing is required on fifteen (15) sites in Mustang Park and on two (2) sites in Holiday Park. The re-inspection deduction is made as follows: $ 40.00 X Number of re-inspections = Deduction $ 40.00 X 2 = $ 80.00 PART 9. LIST OF FEDERAL HOLIDAYS 1. New Years Day January 2. Martin Luther King Jr Day January 3. Presidents Day February 4. Memorial Day May 5. Independence Day July 6. Labor Day September 7. Columbus Day October 8. Veterans Day November 9.
