Description
It is the intent of the Government to purchase CA software maintenance services using sole source procedures as identified in FAR 6.302-1. Contractor shall provide CA software maintenance services for the Dept. of Veterans Affairs Corporate Data Center Operations located at 1615 Woodward Street, Austin, TX 78772. 1. Requesting Agency: U. S. Department of Veterans Affairs, Corporate Data Center Operations, Austin Information Technology Center Contracting Activity: Information Technology Acquisition Center, 1615 Woodward Street, Austin, TX 78772 2. Nature and/or description of the action: The CDCO operates IBM mainframe servers to support its customers needs to run financial, decision support and statistical reporting mission critical applications at its campus in Austin, Texas. This processing environment uses CA software to manage the processing workload. This contract is an anticipated sole source award of a fixed price contract for maintenance on previously acquired CA software with an increase in the MIPs-based license ceiling to continue to meet the processing needs. The estimated cost is $xx million for a base year and six 1-year option periods as follows: Base period 4/1/09 3/31/10 $xxM Option Year 1 4/1/10 3/31/11 $xxM Option Year 2 4/1/11 3/31/12 $xxM Option Year 3 4/1/12 3/31/13 $xxM Option Year 4 4/1/13 3/31/14 $xxM Option Year 5 4/1/14 - 3/31/15 $xxM Option Year 6 4/1/15 - 3/31/16 $xxM 3. A description of the supplies or services required to meet the agency's needs: This contract is a follow-on contract with CA for software maintenance for all CA software currently running on CDCOs mainframe systems which includes the IBM z9 and IBM z890. 4. An identification of the statutory authority permitting other than full and open competition. FAR 6.302-1(a)(2) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: CA (formerly called Computer Associates) is the owner of the software for which maintenance is being requested. CA has the source code which is required to support patches, updates and respond to software errors. CA has all proprietary rights to the software source code and has not released the source code to other vendors to maintain the software products. Therefore, no other vendor can maintain the software as they must have permission, access, and ability to modify source code in order to meet the minimum needs of the CDCO. Obtaining replacement software products with similar functionality from other sources for the renewal software would result in disruption to the mission in addition to major software conversion costs. The Government has expended approximately $30 million on CA software products. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. This effort will be posted in FedBizOpps as a planned sole source award to CA for maintenance of the software listed in Attachment A. 7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The anticipated costs of $xxM for the entire contract with all options is determined to be fair and reasonable based on historical experience with CA maintenance and negotiations. 8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. This effort will be posted in FedBizOpps as a planned sole source award to CA for maintenance of the software listed in Attachment A. The synopsis will state that all responsible sources may submit a capability statement which will be considered and the Government will review any capability statement submitted against the requirement to determine their ability to meet the Governments requirements. 9. Any other facts supporting the use of other than full and open competition: Only CA can provide the maintenance on their software products. Authorized resellers of CA software will not be able to meet the requirement for providing a minimum of 15% of the cost of the value-added service as CA will be providing the maintenance support. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. The Office of Information and Technology program office continually assesses the best software solution for mainframe processing and future requirements will be evaluated to determine and provide for the Governments best interest.
