- NAICS Code: 541380 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, and Subpart 13.106 as supplemented with additional information included in this notice. EPA's Office of the Inspector General (OIG) has a requirementfor testing of 40 to 60 Energy Star Residential Light Fixtures and 40 to 60 Energy Star Compact Fluorescent Light Bulbs as set forth in the Performance Work Statement (PWS) below. All offerors shall submit a fixed rate per test quotation that includes all necessary personnel, equipment, tools, materials, supervision, and services to test lighting products designated as Energy Star to determine whether they meet the Energy Star specifications. This electronic version of the Request for Quote (RFQ) is the official version for this acquisition. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. Request for quotation number RFQ-DC-09-00320 shall be referenced on any quotation. The solicitation document and incorporated provisions and clauses are those in effect thru Federal Acquisition Circular 2005-04. Offerors are encouraged to check the EPA website at http://www.epa.gov/oamhpod1/adm_placement/sapcbd/energystar.htm and the Federal Business Opportunity (FEDBIZOPS) website at http://www.fedbizops.gov for any amendments to this combined synopsis/solicitation. All questions concerning this RFQ must be submitted via e-mail to the Contracting Officer only at gosnell.jody@epa.gov, by 2:00 pm on January 15, 2009. No telephonic response to this solicitation will be accepted. All responses to questions will be posted by way of an amendment to this combined synopsis/solicitation to the FEDBIZOPS and EPA websites. The Government intends to make only one award to fulfill the requirements outlined in this PWS. The contract award will be a fixed rate purchase order. Award date is expected to be no later than February 2, 2009. The Government will award to the responsive, responsible firm, whose quotation is most advantageous to the Government, price and other factors considered. This is best-value procurement. The Government may or may not award to the low price quotation. The NAICS Code assigned to this project is 541380. The due date for receipt of responses to this RFQ will be 3:00 pm on January 29, 2009 via e-mail and one original copy to U.S. Environmental Protection Agency, 1200 Pennsylvania Avenue, NW, ATTN: Jody Gosnell, Mail Code 3803R, Washington, DC 20460 via U.S. Mail; or to U.S. Environmental Protection Agency, ATTN: Jody Gosnell, 1300 Pennsylvania Avenue, NW, Reagan Building Room 71222, Washington, DC 20004 via commercial delivery; and e-mail to Jody Gosnell at gosnell.jody@epa.gov Performance Work Statement (PWS) for Testing of Lighting Products Compliance with Energy 1.0 Background The mission of the U.S. Environmental Protection Agency's (EPA) Office of Inspector General (OIG) is to perform independent work that helps ensure the integrity of EPA programs and operations by promoting economy, efficiency, and effectiveness. In addition, the OIG seeks to detect and prevent fraud, waste, and mismanagement in Agency programs and operations. Energy Star is a joint program of the EPA and the U.S. Department of Energy (DOE) helping to save money and protect the environment through energy efficient products and practices. In 1992, EPA introduced Energy Star as a voluntary labeling program designed to identify and promote energy-efficient products to reduce greenhouse gas emissions. Computers and monitors were the first labeled products. To participate manufacturers self-certify that at a minimum, their products comply with the Energy Star specifications for that product. Through 1995, EPA expanded the label to additional office equipment products and residential heating and cooling equipment. In 1996, EPA partnered with the DOE for particular product categories. The Energy Star label is now on major appliances, office equipment, lighting, home electronics, and more. EPA has also extended the label to cover new homes, and commercial and industrial buildings. The EPA OIG plans to select Energy Star qualified lighting products and have them tested to determine if they meet applicable Energy Star product specifications. This independent testing will help to verify whether EPA's self-certification process provides reasonable assurance that test results provided by partners and others are representative. 2.0 ScopeThe contractor shall provide any and all necessary personnel, equipment, tools, materials, supervision, and services to test lighting products designated as Energy Star to determine whether they meet the Energy Star specifications. All products will be procured by the OIG and remain the property of the OIG; and must be returned to the OIG upon completion of testing. The contractor shall perform all tests in accordance with Energy Star testing methodologies located at http://www.energystar.gov/. The contractor must be accredited by the National Voluntary Laboratory Accreditation Program (NVLAP). The contractor must provide assurance that it has the resources to employ test methods specified by the Energy Star's Eligibility Criteria located at http://www.energystar.gov/. for each product selected for testing. The contractor must maintain the applicable certifications or specification requirements that are specified by Industry or by the Energy Star testing guidelines located at http://www.energystar.gov/. The contractor shall provide personnel with background and expertise in areas germane to the objectives.2.1 Contractor Personnel 2.11 Project Manager. The contractor shall provide a project manager who shall be responsible for the performance of work and certified to oversee testing. The name of this person, and an alternate who shall act for the contractor when the manager is absent, shall be designated in writing to the Contracting Officer and their representative. 2.12 The project manager and alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. 2.13 The project manager and alternate shall be available during normal business hours, with reasonable notice, to discuss the project. 2.2 Contractor Employees 2.21 Before starting work under this contract, contract employees performing testing must have all applicable certification and/or specification requirements that are specified by Industry and/or by the Energy Star testing guidelines. Proof of these certifications and statements that the personnel do not have a conflict of interest will be submitted to the Contracting Officer and their representative prior to starting work under this contract. 2.22 Conflict Of Interest. In order for the OIG to evaluate any potential conflict of interest, please disclose any and all Energy Star product testing performed for private manufacturers, Environmental Protection Agency, or Department of Energy within the last five years. The selected vendor also cannot be currently employed by any of the above entities to perform work duplicative to that referenced in the PWS. 2.23 The contractor must provide proposed subcontractors and obtain approval prior to subcontracting out any testing required under this contract. Subcontractors must meet the same requirements and standards as the prime described in the Performance Work Statement. 2.24 The contractor shall not utilize the services of any person who is an employee of the U.S. Government if employing that person would create a conflict of interest in work performed under this contract. 3.0 ObjectivesThe objective of this work is to test Energy Star lighting products to determine whether they comply with the Energy Star specifications for those products. Repeat testing may be requested for some products after initial test results are received. In addition, other Energy Star products may be tested if OIG determines a need to do so. This information will be used to protect Energy Star brand integrity and strengthen the EPA Energy Star's quality assurance program. 4.0 Tasks4.1 Procurement of Energy Star Products For each of the product types, the OIG will procure the products selected for testing and have them shipped to the contractor. The contractor will check the received products to ensure they are listed on EPA's Energy Star's database as qualified Energy Star products prior to testing. The contractor shall keep all packaging materials and repackage the product in its original packing materials when testing is complete and return to the OIG. 4.2 TestingThe contractor shall conduct product testing in accordance with EPA/DOE Energy Star's partner commitments, applicable specifications, and current testing protocols to determine whether products are Energy Star compliant (i.e., whether each meets the criteria for bearing the Energy Star logo.) The contractor shall obtain these protocols, specifications and partner commitments from EPA/DOE's Energy Star website. 4.3 Quality ControlThe contractor shall submit a Quality Control Plan to the Contracting Officer or his or her Representative prior to award. The contractor must demonstrate it has the resources to conduct test methods specified by the Energy Star's testing guidelines. The plan shall include procedures for identifying problems, correcting them, and ensuring they do not re-occur.4.31 The testing records shall be kept and made available to Contracting Officer and their representative throughout the contract performance period. 4.32 Contracting Officer and their Representative reserves the right to subject the contractor to announced and unannounced inspections of contractor facilities where work is performed. 4.4 Logs The contractor shall prepare and maintain logs for all products tested including product name, product type, model number, and serial number. 4.5 Meetings 4.51 The contractor shall be required to attend various meetings. These may include OIG personnel, EPA personnel, and personnel from other Government agencies, personnel from civilian offices, the public or any combination of the above. Contractor personnel may be required to present briefings at these meeting and otherwise support the OIG concerning test results and conclusion regarding product compliance with Energy Star specifications in meeting with EPA as well as manufacturers and stakeholders. 4.52 A time will be established for a monthly meeting with representatives from the OIG to review open testing requirements. A proposed agenda will be provided at least 48 hours prior to the meeting so that the contractor may have the appropriate employees in attendance. The contractor's on-site project manager will attend each meeting. Subjects to be discussed will include the contractor's proposed approach to new or ongoing work, and other topics requiring coordination.4.6 Shipment Instructions for Tested Products Upon completion of testing of an item, the item shall be repacked in its original packaging and stored for return shipping. The contractor will be responsible for all packing and shipping costs associated with test products. EPA OIG will notify the contractor when to return all tested items and will provide associated shipping information to the contractor. 4.7 Reporting Upon completion of testing for each product category, the contractor shall prepare a draft report and provide it to EPA OIG. At a minimum, each report shall include:- a list of each product tested, including product name, manufacturer, model category and number. - a description of the testing method(s), analytical instrumentation results and statement of compliance with Energy Star testing protocol. - listing of any products found not to comply with Energy Star specifications. - calibration procedures and results of quality assurance runs associated with the individual product category testing. - an EXCEL spreadsheet or other written documentation of all products tested comparing the contractor's test results to Energy Star's specification and indication of compliance results. - the contractor will be available to answer any questions on the draft reports before the final reports are issued. - the contractor will not provide copies of its report to any person or entity outside of EPA OIG. 4.8 Dates The contractor shall commence product testing activities no later than two (2) weeks after the contract award. Product testing for all products should be completed within six (6) months of contract award. 5.0 Deliverables All work associated with this contract must be completed within one (1) year of contract award. All deliverables shall be created using OIG standard software (Microsoft Office 2003) and shall be provided both in paper and electronically (one copy to the Contracting Officer and one copy to the Project Officer.) 5.1 Status Reports For each product tested, the contractor shall provide monthly status reports that contain activities performed and preliminary results obtained during the previous 30 calendar days including hours and other costs charged against the task order. These reports should be submitted by the 10th day of the following month. 5.2 Test Reporting For each product tested, the contractor shall compile the results into a draft report that will include a description of the product testing methodology used, the results of product testing, an analysis of those results, and conclusions regarding whether the products meet Energy Star specifications. Draft report is due within 15 days of product testing.5.3 LogsFor product tested, the contractor shall provide the OIG with the testing logs described under 4.4 above. The testing logs shall be provided in paper and electronically in a Microsoft Excel spreadsheet.5.4 Final ReportPrior to completion of this contract, the contractor shall compile the results from all testing into a single report containing findings and conclusions regarding the compliance of Energy Star products with Energy Star specifications. The final report should be submitted within 30 days of the OIG's acceptance of all draft reports. 6.0 Government Furnished Property No government property shall be furnished for the execution of this work. 7.0 Security 7.1 Security Requirements The contractor shall be responsible for the security of all contractor-owned supplies, material, equipment and facilities. 7.2 Safety Requirements 7.21 The contractor shall provide for the safety and protection of personnel employed in support of this contract. The contractor shall comply with all Occupational Safety and Health Act (OSHA) as well as State, local and EPA safety regulations. Additional test site requirements may be defined in each written technical direction. 7.22 Prior to the contract award, the contractor shall submit a safety plan for the contract organization that addresses accident prevention and reporting and other ways of protecting personnel from injury, to include regular safety training. Contracting Officer or his or her Representative will review the plan and provide comments within 15 days. 8.0Technical Proposal Instructions The technical proposal must be specific, detailed and complete to clearly demonstrate that the offeror has a thorough understanding of the requirements outlined in the PWS. Clear evidence of services/processes previously demonstrated and currently in place relating to the technical evaluation criteria should be included. Statements that the offeror understands, can, or will comply with all statements in the PWS, and statements paraphrasing the PWS are considered insufficient. For example, statements such as "standard procedures will be employed," or well-known techniques will be used," etc., will be considered insufficient. Elaborate brochures or other presentations beyond that sufficient to present an effective proposal are not desired. 8.1 Past Performance Each offeror shall identify up to three contracts, which have recently been performed (within the last five years), or are currently performing, which are similar in scope for services of this magnitude and complexity. The offeror shall provide the following information with respect to each of these contracts: *Contract number, contract type and dollar value*Date of contract award and period of performance*Name, address and telephone number of all applicable contract points of contact*Brief description of contract work, scope, and responsibilities The quality of work, timeliness, cost control, management and customer satisfaction will be evaluated by contacting those references. 8.2 Personnel and Technical Requirements Each offeror shall provide the following: (1) List of personnel who will be assigned to this contract and the functions that each will be performing, (2) Resumes (education, expertise, credentials and experience) for each person to be assigned to this contract (2-3 pages in length), (3) Licenses and certifications including a list of methods approved for, and (4) Evidence of a Quality Control Plan with Quality Assurance manuals and applicable Standard Operating Procedures in place. The provision at FAR 52.212-1 "Instructions to Offerors-Commercial" applies to this acquisition. Offerors are to include a completed copy of FAR provision 52.212-3 "Offeror Representations and Certifications - Commercial Items" with their response.
