Description
The National Cancer Institute (NCI), Center for Cancer Research (CCR), Radiation Oncology Branch (ROB), plans to procure on a sole source basis the brand name a High Performance Couch Upgrade for Tomotherapy HI-ART Accelerator from Tomotherapy Inc., 1240 Deming Way, Madison, WI 53717-1954. This acquisition will be conducted under the procedures for acquiring commercial items authorized in FAR Part 12 and under the authority FAR 13.501 to use simplified acquisition procedures for commercial items. The North American Industry Classification System code for this acquisition is 334516 and the business size standard is 500 employees. The Radiation Oncology Branch of the CCR treats cancer patients with radiation according to approved clinical protocols. One of the treatment modalities employed by ROB is helical tomotherapy. This employs an advanced, integrated system for treatment plan optimization, pre-treatment imaging and treatment delivery. This system permits the treatment of cancerous lesions which are in close proximity to vital normal structures, such as the spinal cord. This system permits ROB to successfully treat patients that are untreatable by conventional modalities. The salient characteristics for the required system are as follows: 1. Consists of a complex inverse planning computer system 2. Uses 16 parallel processors 3. Has an integral data communications network for storing and transferring patient and treatment data 4. Has a HI-ART ( H elical I ntensity modulated A daptive R adiation T herapy) accelerator, which uses a high speed binary multi-leaf collimator to shape the dose distribution delivered to the patient as the gantry rotates and the patient is moved automatically through the radiation field, creating a helical treatment pattern PART II. Facts and Reasons To Justify Other than Full And Open Competition 1. Statute: 13.106-1 (b)(2) (b) Solicitation from a single source. (2) For Sole source acquisition of commercial items in excess of the simplified acquisition threshold conducted pursuant to subpart 13.5, the requirements at 13.501(a) apply. 2. Sole Source Justification Tomotherapy Inc. is the sole distributor of the HI-ART Helical Tomotherapy System. All system components are highly integrated through both proprietary hardware as well as software. ROB purchased an early version of the HI-ART system 2 years ago and, while it is an excellent system, it has suffered from several deficiencies, all of which involve the original couch design. These are (1) unlike vertical and longitudinal position, the lateral position is a manual adjustment and prone to operator error, (2) the vertical motion is not a true vertical movement, but an arc that changes the longitudinal position as the vertical is changes, requiring an unnecessary repositioning, and (3) the original couch top is a thin piece of carbon fiber and suffers from “springboarding”; hence the couch top sags as it is moved into the gantry bore, changing the position of the patient relative to the setup position. Tomotherapy Inc. has recognized these problems and has developed a High Performance Couch that it offers as an upgrade to the system. Since it was developed and is exclusively marketed by the manufacturer, it will be fully integrated with the existing system and, as such, will not void the existing and on-going maintenance contract that ROB has with the vendor. This is not a solicitation for competitive quotations. However, if any interested party believes it can perform the requirement as detailed they may submit a statement of capabilities. All information furnished shall be in writing and must contain sufficient detail to allow the NCI to determine if it can meet the above unique specifications described herein. An original and one copy of the capability statement must be received in the contracting office on or before 11:00 am ET, on February 17, 2009. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
