The Contractor and its employees shall exercise the utmost discretion in regard to all matters relating to their duties and functions. They shall not communicate to any person any information known to them by reason of their performance of services under this contract which has not been made public, except in the necessary performance of their duties or upon written authorization of the Contracting Officer. All documents and records (including photographs) generated during the performance of work under this contract shall be for the sole use and become the exclusive property of the U.S Government. Offerors should verify in writing which items are listed on their GSA schedule contracts and which items are "open market" items. For an offer to qualify as an offer based on a GSA schedule contract, the value of "open market" items included in the offer may not exceed the applicable micro-purchase threshold as defined in FAR 2.101.In order to notate which items are open market, in accordance with FAR 8.402(f)(3), Seller must write "open market" in the Line Item Description for any item not currently active on the cited contract, or list in the Seller Bid Description field all open market line numbers (e.g. "Open Market Items: Lines 1, 2, 3.") The Office of Acquisition Management (LM/AQM), Department of State, is processing this acquisition at the request of the Radio Programs Branch. This Justification and Approval (J&A) is for procurement of Pro-Type Industries, Inc. equipment under a sole-source justification. In order to avoid the high cost of purchasing complete HF base stations we are seeking to have a custom chassis produced to convert 150 HF mobile radios (currently in stock) into bases stations. The supplies and services requested are not available as COTS end items and are customized for RPB based on dimensions and design elements. Pro-Type Industries, Inc. provides design, prototyping, fabrication, and production services of custom products and has specific knowledge of the design elements RPB requires to manufacture the items sought. Furthermore, because Pro-Type Industries, Inc. has already developed a prototype for RPB, it would be cost prohibitive to obtain production units from another vendor, as the process would need to be repeated and another prototype would need to be developed. The Bureau of Information Resource Management (IRM), Radio Programs Branch (RPB) requires the procurement of this equipment from Pro-Type. Limitation of competition under simplified acquisition procedures is permitted when justified by FAR 13.501 and 41 USCode 253(c)(1). An extensive internet search was conducted to identify potential vendors. Due to the custom nature of the products desired, it is essential that the vendor be able to provide rapid in-person response during the design and manufacturing phases.
