POSITION TITLE: EEO Consultant Solicitation #ADF-09-R-068 - EEO Consultant - Personal Services Contract DESCRIPTION: This is a combined synopsis/proposal for the recruitment of qualified applicants interested in providing Personal Services Contract (PSC) Services as described herein and as supplemented with additional information prepared in accordance with Federal Acquisition Regulations (FAR) Subpart 12.6. This announcement constitutes the only solicitation. Proposals are being requested and a written solicitation shall not be issued. This requirement is being issued as a Request for Proposal (RFP) and the solicitation number is ADF-09-R-068. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Regulations. The North American Industry Classification System (NAICS) code is: • 541611 - Administration Management Consulting Services CONTRACT TERMS AND CONDITIONS Solicitation Provisions Incorporated by Reference - F.A.R. Contractor personnel, although not Government employees, shall comply with Executive Order 11222, May 8, 1965, "Prescribing Standards of Ethical Conduct for Government Officers and Employees," and shall comply with ADF regulations implementing this Executive Order. SCOPE OF WORK - EEO CONSULTANT MARKET VALUE: Final compensation will be negotiated within the listed market value based upon the candidates' past salary, work history and education background. I BACKGROUND The African Development Foundation (ADF) is a Federal independent corporation of the United States Government. Its mandate is to foster community-based development in Africa. ADF programs focus on: (a) Responding to the priority needs of grassroots communities and marginalized groups (b) Assisting indigenous small and medium-sized enterprises to engage in profitable and sustainable local, regional, and international trade (c) Documenting, promoting, and disseminating best practices related to community based participatory development and to enterprise development; and (d) Providing conventional grants to non-governmental organizations and community reinvestment grants to indigenously owned businesses in African countries II INTRODUCTION This position is located in the Office of the President/CEO of the African Development Foundation. The incumbent serves as an Equal Employment Opportunity (EEO) technical authority and provides advisory services, technical assistance and guidance to the President/CEO and ADF senior management staff on a broad range of complex, highly sensitive, and confidential issues and problems pertaining to discrimination complaints and related issues. III GENERAL REQUIREMENT The incumbent serves as Equal Employment Opportunity Professional and Advisor. Major duties and responsibilities are as follows: Review of Management Practices: • Serves as a well known expert and well established technical authority responsible for reviewing, analyzing, planning, developing, implementing, and assessing ADF past, present and potential discrimination complaints • Meets and talks with ADF senior management (General Counsel, Director of Administration and Management and Chief Human Capital Officer, EEO Director, Chief Financial Officer, Performance Management Advisor, and others on the management team), to identify any management practices, organizational culture or problem areas which includes any barriers (perceived or hidden) and/or subtle actions which may be considered discriminatory that have or may contribute to past, present and potential future complaints • Works and strategizes with senior management to develop action plan(s) and initiatives to correct identified problems and issues, including minimizing or eliminating negative, adverse or perceived impact in ADF • Reviews informal EEO complaints of discrimination for systemic problems, management practices and other issues that may breed retaliation • Conducts fact-based complaint reviews and assists management in responding to complaints and charges of discrimination, including Alternative Dispute Resolution applications and grievances, alleged wrongdoing, and representation of the client before the EEO. As necessary, assists in preparing documentation such as settlement agreements and releases which may entail conducting fact-finding to obtain relevant information to determine if management or employee's action was discriminatory; and • Provides the Agency with a detailed report on findings and, as appropriate, work with Agency officials to affect a resolution Organizational Structure: The incumbent analyzes and studies the total organizational culture to provide sound advice, guidance and recommendations to the President/CEO on ADF's organization to: • Determines the appropriateness of ADF's current organizational structure, and • Addresses EEO issues • Prepares in-depth written and statistical reports related to: - Discovery of EEO practices and policies, and resolution thereof - Recommendations to improve work processes; and - Systems to foster and develop interpersonal relationships between management and employees • Strategizes approaches and methods with ADF management to develop or improve the necessary processes, practices or methods used for managing/and handling employee complaints. Training Program : Develops and implements an effective EEO Training Program, which includes: • Developing a curriculum and schedule tailored to ADF's needs, and • Informing and assisting management in identifying and preventing behaviors that contribute to Agency EEO complaints Identifies problem areas and develops action-oriented programs and initiatives to resolve problems in an effort to minimize negative, adverse, or perceived impact; and Works with the President/CEO and senior management staff to develop and implement EEO awareness programs and training initiatives. IV SUPERVISORY CONTROLS: The Equal Employment Opportunity (EEO) Professional reports directly to the President/CEO of the ADF, and has overall responsibility for equal employment opportunity within the Agency. The EEO Professional is responsible for the following: • Planning and organizing work and special projects • Coordinating with other staff • Conducting all phases of assignments; and • Discussing or referring potentially sensitive, controversial issues, which can or will have an impact on policy and practices with the President/CEO Regular and recurring assignments are reviewed for overall effectiveness, soundness of analysis, technical adequacy, and conformance with procedures and instructions. The incumbent meets weekly, or as required, to keep the President/CEO apprised of potentially sensitive and controversial issues. The President/CEO reviews completed work for soundness of overall approach, effectiveness relative to expected results, and feasibility of recommendations. Equal Employment Opportunity functions performed by the incumbent are assumed technically correct based on the incumbent's mastery subject-matter expertise. The incumbent, at minimum, has served at the capacity of General Counsel for Equal Employment Opportunity matters or issues in a Federal Agency or comparable organization. V DESIRED QUALIFICATIONS The EEO Professional utilizes his/her vast wealth of knowledge of Federal EEO policies, practices, and regulations in conjunction with ADF policies and procedures, including knowledge in: • Federal Government Employment Discrimination Law • Labor Law • Title VII of the Civil Rights Act of 1964 • Section 504 of the Rehabilitation • Act of 1973, the Americans with Disabilities Act • The Age Discrimination in Employment Act • The Equal Pay Act (EPA) of 1963 • Executive Order 13087- Sexual Orientation • Title 29 • Code of Federal Regulation (CFR) Part 1607 • Uniform Guidelines on Employee Selection Procedures, dated 1978; et.al. In the event, there is no existence of guidelines; the incumbent develops policy in consultation with the President/CEO. VI COMPLEXITY: The incumbent utilizes his/her expert analytical skills to identify the nature and scope of problems or issues, and analyzes factual data. The incumbent determines the appropriate methods and techniques to resolve problems and issues, and makes recommendations to the President/CEO. The incumbent must analyze the ADF's programmatic goals and objectives to determine their impact on the equal employment opportunity program. The incumbent may be brought in after implementation of new goals and objectives to ensure compliance, and revise existing policy or create new policy to accommodate the programmatic change. VII SCOPE AND EFFECT: The incumbent will provide technical expert level assistance to the President/CEO and ADF senior management, which have Agency wide impact. VIII BENEFITS/ALLOWANCES: As a matter of policy, and as appropriate a PSC is normally authorized the following benefits and allowances: • Employee's FICA contribution; • Contribution toward Health and Life Insurance; • Pay Comparability Adjustment; • Eligibility for Worker's Compensation; • Annual and sick leave; AND • Any other negotiated benefits allowable under F.A.R. subpart 31 ADF Personal Service Contractors are not exempt from payment of Federal Income Taxes. The Contractor shall ensure that all his/her taxes and other legal obligations associated with performance under this contract are satisfied. XI METHOD OF AWARD ADF anticipates awarding one personal service contracts as result of the solicitation. Please note that this does not constitute any guarantee that a PSC will be awarded because of this solicitation nor does it constitute any authorization by ADF to reimburse costs incurred in the preparation of the proposal. Award shall be made based on the best overall value to the Government. The Contracting Officer (CO) shall use the technical merits of each proposal to determine the successful Offeror.
