- The Department of Veterans Affairs, VA Boston Healthcare System, intends to negotiate a commercial (FAR Part 12) sole source contract with Biosense-Webster Inc. under the authority of FAR 6.302-1. Please refer to the Sole Source Justification. This is not a solicitation; it is notice of intent to sole source a requirement. Inquiries/information received after the established deadline shall not be considered. The submission of any data for review shall not impede award of this contract as planned. The Government does not intend to pay for information solicited. This synopsis is issued pursuant to FAR 6.302-1. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the agency and the contracting activity Electrophysiology Laboratory, Medical Service, V.A. Boston Healthcare System, West Roxbury, MA 2. Nature and/or description of the action being approved. CartoSound Image Integration Software Module upgrade to existing Carto XP Cardiac Electroanatomical Mapping System from Biosense-Webster, Incorporated 3. Description of the supplies or services required to meet the agency's needs including the estimated value). CartoSound Image Integration is a modular software package Upgrade to the Carto XP System already on station which is owned by the V.A. Boston Healthcare System. This software package facilitates the integration of real-time Intra-Cardiac Echocardiography, ICE, images acquired during interventional electrophysiology procedures, providing concurrent side by side analysis of patients anatomy without undue or repeated manipulation of cardiac needles, wires, sheaths or catheters potentially causing deleterious events and minimizing medical staff and the patient to excessive ionizing radiation. The CartoSound System is compatible with the Siemens Cypress AcuNav ICE Echo machine already on station which as well has previously been acquired by V.A. Boston Healthcare System. The Medically ordered utilization of the Carto XP System upgraded with CartoSound is authorized by the Medical Director of the Electrophysiology Laboratory. The authorization of medical technology of advanced application provides a community standard of care to VISN 1 patients in that performance of procedures will be more safely executed and not to use an imaging system of such great capacity could result in injurious procedures, protracted procedures exposing patients and laboratory staff to excessive ionizing radiation and extended therapeutic procedures expose patients to infectious processes. Biosense-Webster, Inc. is the sole source vendor for this sophisticated software upgrade and they maintain proprietary solicitation rites to their distribution. Not to upgrade the existing system and utilize this technological imaging enhancement could compromise patient care and extend and magnify hospitalizations for therapeutic management of Congestive Heart Failure, CHF. This system upgrade and capital expenditure is advantageous to the V.A. Boston Healthcare System. (Estimated Cost: $45,000.00) 4. Identification of the statutory authority permitting other than full and open competition. FAR 6.302-1 ONLY ONE RESPONSIBLE SOURCE 5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Biosense-Webster, Incorporated, BWI, holds the proprietary manufacturing and distribution rites of the CartoSound Image Integration Software Module. BWI has demonstrated their leadership capacity throughout the industry with technological advancements and release of superior products in the diagnosis and therapeutic treatment of cardiac dysrhythmias which commonly result in precipitous patient morbidity and mortality. BWI is a division of Johnson & Johnson Corporation, setting the standard for innovation in the provision all type of cardiovascular and electrophysiology care. BWI has demonstrated over the years their commitment to excellence in educational, training and supportive programs directed at medical staff to meet the hospital needs of patient care. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a Commerce Business Daily notice was or will be publicized as required by subpart 5.2 (copy attached) and, if not, which exception under 5.202 applies. Biosense-Webster, Inc. is the sole manufacturer and distributor of this specialized software system upgrade. 7. Determination by the contracting officer that the anticipated cost to the government will be fair and reasonable. Determination was conducted and the anticipated cost to the government is fair and reasonable based on commercial price for products would be $75,000.00 a discounted price for the government @ 40% total being of purchase is $45,000.00. 8. Description of the market survey conducted (i.e., names of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted. 1.)Medtronic Corporation. 2.)St. Jude Medical, a Division of Daig Corporation. 3.)Boston Scientific Corporation. 4.)Spectranetics, Inc. 5.)ELA a Division of Sorin Medical 9. Any other facts supporting the use of other than full and open competition, such as an explanation why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. The incorporation of a sophisticated technology such as CartoSound will limit procedural times associated with patient and staff exposure to ionizing radiation. This cannot be over-emphasized secondary to the known medical fact that ionizing radiation is hazardous to humans and utilization of an alternative imaging format will minimize that procedural associate health risk. 10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. N/A 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Contracting Activity will continue to encourage brand name or equivalent specifications
