Description
Updated Price list as of 03 Mar 2009. This is an updated Statement of Work as of 03 Mar 2009. This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation is being issued as a Request for Quotation (RFQ). This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-30. This procurement is a 100% Small Business set-aside IAW FAR 19.502-2 (a). The NAICS code is 541380 the small business size standard is $12.0 million. The Government intends to issue multiple pre-priced Blanket Purchase Agreements (BPAs), for lab testing services as outlined in the attached Statement of Work. Method of payment will be Government Purchase Card (GPC). The provision at FAR 52.212-2, Evaluation of Commercial Items, is completed as follows: Award will be made to the offeror whose offer conforms to the solicitation requirements and provides the lowest total price. The following provisions and clauses apply to this acquisition: The clause at FAR 52.204-7, Central Contractor Registration; FAR 52.209-6, Protecting the Government's Interest When Subcontracting with Contractors Debarred, Suspended, or Proposed for Debarment. The provision at FAR 52.212-1, Instructions to Offerors--Commercial Items. The provision at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items. The offeror must include a completed copy of this provision with their proposal. The clause at FAR 52.212-4, Contract Terms and Conditions-Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders--Commercial Items. DFARS 204-7003, Control of Government Personnel Work Product; DFARS 252.204-7004, Required Central Contractor Registration; DFARS 252.212-7001, Contract Terms and Conditions Required to Implement Statues or Executive Orders; specifically, the following clauses cited within DFARS 252.212-7001 are applicable to this solicitation: DFARS 252.232-7003, Electronic Submission of Payment Requests; DFARS 252.243-7001, Pricing of Contract Modification (Dec 1991); DFARS 252.247-7023, Transportation of Supplies by Sea, Alternate III. The full text of the above-referenced FAR and DFARS provisions and clauses may be found at http://www.arnet.gov. All responsible sources may submit a proposal which, if timely received, must be considered by the Agency. All prospective offerors interested in submitting a quote, must have a Commercial Government Entity (CAGE) code. All potential sources must obtain a DUNS number and register in n the Central Contractor Registration (CCR) database at www.ccr.gov in order to transact business with the Government. Failure to obtain a DUNS number, register in ORCA and register in the CCR may result in the delay of award of a contract or possible award to the next otherwise successful offeror who is registered at the time of award. One of the following paragraphs will apply: (a) prospective offerors shall complete electronic annual Representations and Certifications at http://orca.bpn.gov in conjuction with required registration in the CCR database (see FAR 4.1102), or (b) prospective offerors shall update the Representations and Certifications submitted to ORCA as necessary, but at least annually, to ensure they are kept current, accurate and complete. The Representations and Certifications are effective until one year from date of submission or update to ORCA. Note: A search in ORCA will be accomplished to ensure compliance. IAW AFFARS 5352.201-9101: OMBUDSMAN (AUG 2005) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (d) The ombudsman has no authority to render a decision that binds the agency. (e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. SOME DELAY SHOULD BE ANTICIPATED. Offerors should allow sufficient time to obtain a visitor's pass and arrive at the depository PRIOR to the time established for receipt of offers. Late proposals will be processed in accordance with FAR 15.208, Submissions, Modifications, Revisions and Withdrawals of Proposals.
