- The statutory authority permitting other than full and open competition is Title 10, U.S.C. 2304 (c) (1) as implemented by the Federal Acquisition Regulation (FAR)6.302-1, only one responsible source as referenced by the name brand citation, “Chronicle Software”which is proprietary to Redwood Software Incorproated. Redwood is the only provider of this software. The FSC Code is 7030 and the NAICS Code is 51120. A copy of the solicitation will be available via the DLA Procurement Gateway at http://progate.daps.dla.mil on the issue date cited in the RFQ. From the Gateway homepage, select “Search RFQs” from the left –hand side bar. Then choose the RFQ you wish to download. RFQs are in portable document format (PDF). To download and view these documents you will need the latest version of Adobe Acrobat Reader. This software is available free at http://www.adobe.com. A paper copy of this solicitation WILL NOT be available to requestors. The final contract award decision may be based upon a combination of price, past performance, and other evaluation factors as described in the solicitation. The solicitation issue date is: March 9, 2009. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation document and incorporated provisions and clauses are those in effect through the applicable acquisition circular. The provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition in regards to any addenda to the provision. This provisions applies; 52.212-2, Evaluation -- Commercial Items, if used, and the specific evaluation criteria to be included in paragraph (a) of that provision. Include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with the offer. The clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition and a statement regarding any addenda to the clause. The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items, applies to this acquisition and a statement regarding which, if any, of the additional FAR clauses cited in the clause are applicable to the acquisition. Warranty requirements for this acquisition will be consistent with customary commercial practices.
