Description
This is a combined synopsis/solicitation prepared in accordance with FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The request for quote number is N6847009RQMR002. The following provisions and clauses apply plus any addenda: FAR 52.212-1 Instructions to Offerors - Commercial Items; FAR 52.212-2 Evaluation - Commercial Items; FAR 52.212-3 Offeror Representations and Certifications --Commercial Items; FAR 52.223-5, Pollution Prevention and Right-To-Know Information; FAR 52.237-2, Protection of Government Buildings, Equipment, and Vegetation; FAR 52.213-3, Notice to Supplier; FAR 52.212-4 Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items; additional FAR clauses cited in the clause are: 52.222-3, Convict Labor; 52.222-26, Equal Opportunity; 52.232-33, Payment by WAWF. NAICS Code for this requirement is 811219. The intention is to award a Firm-Fixed Price contract. The U.S. Naval Hospital, Okinawa, Japan intends to negotiate a sole-source contract with HEALTHTRONICS SERVICE CENTER LLC for repair parts and an onsite one-time preventive maintenance service to include replacement of deteriorated parts on the Medstone STS Lithotripter for the Urology Clinic, USNH Okinawa. However, any responsible source that can meet the requirements may submit the written notification to the Point of Contact (POC). Supporting documents must be furnished in sufficient detail, to demonstrate the offeror’s capability to provide and ability to comply with the requirements. Offerors must be registered in Central Contractor Registration. Note: Lack of registration in the Central Contractor Registration will make a Contractor ineligible for award. Registration is available via the Internet at www.ccr.gov. The Place of Performance is: US Naval Hospital Okinawa, Japan, Camp Lester Bldg. 6000, Chatan-cho, Aza Kuwae, Nakagamigun, Okinawa, Japan 904-0103. The Government will award a contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes: (1) Technical capability of the item quoted to meet the Government requirement (including submission of descriptive literature); (2) Price. Quotes must be submitted to the POC no later than April 5, 2009; 10AM; Japan standard time. Quotes must include air travel expenses and lodging expenses. Quotes shall be submitted via e-mail in Word, Excel, or PDF format to the POC, Jane Shiroma, at Jane.Shiroma@med.navy.mil or faxed to 011-81-98-893-5754. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, U.S. Naval Hospital, Okinawa, Japan will proceed with the sole source procurement. Following are the Parts, Scope of Work, and the Special Contract Requirements. Conductivity Tester; # T-200011; 1 EACH SCOPE OF WORK The manufacturer trained Field Service Engineer (FSE) will provide all services required which will return the equipment to 100% operational state. Repairs, preventive maintenance, and calibration on the equipment listed below shall be performed in accordance with the manufacturer specifications. Nomenclature: Medstone Lithotripter system (including C-arm unit) Manufacturer: Medstone (now Healthtronics Inc) ECN Table: 97566 Model: STS-TC Console Serial: CT-2002-060 ECN C-arm: 97497 Model: Ziehm Vista Current location: Biomed Final location: Urology Clinic Preventive Maintenance and Calibration: Preventive maintenance shall consist of lubrication, cleaning, and adjustment of mechanical parts. Perform integrity check of water treatment, nitrogen systems, positioner, HV system and controls, motion controls, interconnecting cables, ellipse/lens assemblies, check air filters and cleaning of ventilation grills. System calibration shall consist of output energy measurements, performance verification, positioning and aiming adjustments, C-arm calibration which includes mAs, KV, exposure time, focus, magnification, voltage, interlocks, and positioning. All services to be performed shall be in accordance with the manufacturer service recommendations and specifications outlined in the equipment service manual. Required test equipment to be used in the performance of services will be the contractor’s responsibility. All test equipment and/or calibration standards to be used shall be traceable and certified in accordance with NIST standards. Certifications shall be made available to biomed upon request. Training: Biomedical Repair Technician will be observing the preventive maintenance procedures performed by the FSE and shall be provided with a working knowledge of equipment operation including proper preventive maintenance and calibration procedures for the lithotripter system. Field Service Engineer (FSE): The Contractor shall furnish a qualified Field Service Engineer (FSE) who have been trained and certified by the manufacturer. Formal training background shall include performance of preventive and corrective maintenance on the equipment listed above with a thorough working knowledge of each system’s hardware and software. Identification badge identifying the FSE and Contractor’s name must be worn at all times while performing services at the US Naval Hospital. Proof of Specialized Training: The Contractor shall provide proof of specialized training for the FSE responsible for maintaining the contracted equipment. This documentation will be submitted to the Contracting Officer Representative (COR) and a copy kept on file in biomed as long as equipment remains in inventory. No new contractor personnel shall work on the equipment without providing this documentation to the COR. Labor: The contractor will be responsible for all labor services related to the repairs, preventive maintenance, and calibration of the equipment. Parts: Repair parts are not included on this service agreement. Repair parts will be the responsibility of the Biomedical Repair Division. In the event of a component/system failure due to neglect and improper procedures performed by the FSE, the contractor will be responsible for the cost incurred in replacing the parts required to return the equipment to its operational state. Field Service Reports: The contractor shall develop and submit to the Government a report of completed work including but not limited to repair, parts used, preventive maintenance, calibration performed results and inspections completed. The report will itemize all service performed resulting from the services performed Schedule of Performance: Schedule of performance will be determined by Biomedical Repair Division and the contractor to accommodate for travel time and performance of services. The FSE will report to Biomedical Repair Division’s LPO/COR on the first day prior to initiating the services and upon completion of work to discuss any recommendations and issues encountered. SPECIAL CONTRACT REQUIREMENTS Severe Weather No services are required in the event of the following tropical cyclone (typhoon) conditions of readiness: Tropical Cyclone Condition 1-Caution (TC-1C) Tropical Cyclone Condition 1-Emergency (TC-1E) Tropical Cyclone Condition 1-Recovery (TC-1R) Base Passes The government will issue all required base passes to Contractor personnel at no cost to the Contractor. The Contractor shall be responsible for all passes issued under this contract. Passes shall only be used in performance of services under this contract. Passes must be in the Contractor’s possession at all times while on a military installation. The Contractor shall return base passes upon termination or completion of this contract to the Provost Marshal’s Office, Pass and Registration Section, Marine Corps Base, Camp S.D. Butler (extension 645-2239). Certification of receipt shall be obtained and submitted to the Contracting Officer. Any lost or stolen passes shall be reported to the COR immediately and a Military Police report shall be submitted by the Contractor personnel stating the details of the loss or theft. Vehicle Passes All contractor-owned motor vehicles required to be in military installations during the performance of this contract must be registered with the Provost Marshal’s Office, Marine Corps Base, Camp S.D. Butler. Vehicle permits may be issued to civilian contractors for the duration of their contract or until expiration of the identification (ID) pass or vehicle inspection, whichever occurs first. The Contractor shall submit a request for vehicle passes the USNHO MMD for approval by the Contracting Officer. Included in this request shall be the license number, year, make, model, color and operator’s name for each vehicle. Upon approval, the Contractor shall hand carry the request to the Vehicle Registration Section, Building 5638, Camp S.D. Butler. All necessary decals and/or permits shall be displayed on the vehicles in the manner directed by the Vehicle Registration Section (extension 645-7481). Proof of insurance must also be presented to the Provost Marshall upon submission of the temporary vehicle permit or vehicle decal upon request. The minimum requirement for insurance is the Japanese Compulsory Insurance (JCI) under Japanese Motor Vehicle Damage Compensation Guarantee Law. Cost of Operation All cost of operation under this contract shall be borne by the Contractor. This includes but is not limited to taxes, surcharges, licenses, insurance and transportation. No payments other than those provided for in the Price Schedule shall be made to the Contractor. Insurance and Liability It has been determined that no reasonable liability risk exists pertaining as to services rendered under this contract. Therefore, the requirement for the Contractor to maintain liability insurance in this regard is hereby waived. Conciliation Clause for Awards to Japanese Contractors (CS142) 24 May 1962 Except as otherwise provided in this contract, any disagreement arising under this contract, which is not resolved by the parties to this contract, may be submitted to the United States-Japan Join Committee for conciliation in accordance with the Paragraph 10, Article XVIII, of the Status of Forces Agreement under Article VI of the Treaty of Mutual Cooperation and Security between Japan and the United States of America. Request by the Contract for conciliation shall be made in accordance with the following procedures: (a) In the event the Contractor desire conciliation after the decision of the Contracting Officer has been served upon him, he will first file his appeal, from such findings of fact, with the appropriate in accordance with the clause of this contract entitled “Disputes”, within the time limits described therein before filing a request for conciliation with the Joint Committee. Then he may request the appellate authority, under the clause of this contract entitled “DISPUTES”, to suspend its action his appeal until such time as the Joint Committee has had opportunity for effecting conciliation. (b) The request for conciliation will be submitted by the Contractor through the nearest local Japanese Defense Facilities Administration Bureau to the Contract conciliation Panel of the Joint committee. Upon the filing of the request with the Join Committee, the Contractor will immediately notify the Contracting Officer, in writing, that the request for conciliation has been filed. (c) In the event the disagreement submitted to the Joint Committee under subparagraph (b) above has been resolved through conciliation, it will be responsibility of the Contractor to notify the appellate authority, designated in the clause of this contract entitled “DISPUTES”, of the settlement of the dispute and to withdraw his appeal. (d) In the event the Contractor who has submitted a request for conciliation to the Joint Committee under subparagraph (b) above desire, notwithstanding tendency of his request of reconciliation, that action, by appropriate authority under the clause of this contract entitle “DISPUTES”, be resumed on his appeal, it is his responsibility to so request the said authority in writing. The Joint Committee shall be immediately informed by the Contractor of his action taken hereunder. (e) No request for conciliation can be submitted to the Joint Committee in the case of a dispute upon which the final decision of the appropriate authority under the clause of this contract entitled “DISPUTES” has been rendered. Pending the hearing of the conciliation panel, the Contractor shall proceed diligently with the performance of the contract in accordance with the Contracting Officer’s decision. The provisions of this clause shall not prejudice any right which the parties to the contract may have to file a civil suite. Laws Covering Contracts In any dispute arising out of this contract, the rights and obligations of the parties will be interpreted and determined in accordance with the substantive laws of the United States of America. Exemption From Japanese Consumption Tax The Government of the United States and Japan has agreed that this contract will be exempt from the Consumption Tax that took effect on 1 April 1989. Safety and Accident Prevention In performing work under this contract on a Government installation, the Contractor shall conform to the specific safety requirements prescribed by the Government installation and take such additional immediate precautions as the Contracting Officer may reasonably require for safety and accident prevention purposes. The Contractor agrees to take all reasonable steps and precautions to prevent accidents and preserve the life and health of Contractor and Government personnel performing or in any way coming in contact with the performance of this contract on such premises. Any violation of such rules and requirements, unless promptly corrected as directed by the Contracting Officer, shall be grounds to terminate this contract in whole or in part. Lockout Tagout The contractor shall apply Lockout Tagout procedures per NFPA 70E Article 210, as applicable. The Public Works Officer (Facilities) shall be contacted for questions or concerns regarding Lockout Tagout procedures.
