Description
REVISED:This is a sources sought notice. It is the intent of this agency to award a sole source contract under the statutory authority 10 USC 2304(c)(1), set forth in Federal Acquisition Regulation 6.302-1. PROJECT: Professional Cost Share / Rights of Way Services, to provide support in the overall objectives of the Engineering and Lands Depts. If resources within the agency are not available to accomplish Cost Share and Rights of Way Program goals, the contractor will be assigned to independently provide support services to satisfy the overall operational objectives of the Cost Share / Rights of Way program of the Pacific Southwest Region of the Forest Service. The primary objective is to provide contractor services and deliverables through preparing and reviewing cost share agreements, supplements, easement documents and other associated work. Projects will be assigned on an as needed basis resulting in an intermittent workload. Projects will be located on the Eldorado NF. Site visits may be required. Provide to Project Officer, completed and accepted reports, supplements, easements, and other assigned work as monitored by Forest Service permanent employees. Time frames to be discussed and agreed upon throughout duration of project. Responses to inquiries shall be provided within seven calendar days. The contractor must have experience in drafting and administering Cooperative Construction and use Agreements and Agreement Supplements or other agreement binding public and private entities to borne their proportion of funds required to construct and maintain rural road systems. The contractor must have completed at least five agreements which obligate each party to their proportion of funds based on tributary acreage. The Contractor must also be knowledgeable in the fields of federal lands acquisition, environmental requirements and basic engineering knowledge. Other experience or training required: 1. Ten days of formal training in negotiations. The training may include courses provided by the International Right-of-Way Association or public agency sponsored training. 2. Experience must include tasks related to a substantial transportation cost-sharing program, including negotiations, and the preparation and review of cost share supplements for submission to the authorized public agency signatory. 3. Ten days of training in transportation cost share procedures. 4. Submission of five successive agreements to the authorized public agency signatory, acceptable in all aspects and containing no major technical or mathematical errors. 5. Ten successful easement acquisitions including successful title opinion from Office of General Council or other agency equivalent... The Contractor is responsible for: 1. Preparing the following documents in accordance with FSH 5409, FSM 5460, and FSM 2730. Documents shall be delivered as Microsoft Office 2000 format files: a. Standard Road Right-of-Way Construction and Use Agreements and supplements. b. Fact sheets including valuation of easements, construction costs, determination of tributary areas, land classification, and share calculations. c. Easements and permits. d. Title assemblies. 2. Certifying each agreement supplement before signature by Central Zone Cost Share Rights of Way Specialist. The certification consists of a signed and dated statement on the first page of the supplement affirming that it is correct in all respects and meets the required standards and qualifications, including determination of shares, identification of roads, plans and specifications, construction program costs, tributary area, basis of cost sharing, method of payment, and the management of excess cost balances. 3. Other related work as assigned. 4. Forest Service Contact - Greg Connick (530) 478-6150 is the primary Forest Service contact for technical questions and information regarding the scope of work. The Government will consider qualification statements addressing the aforementioned list (include a reference(s) to verify qualifications) received by 2:00 PM local time on April 10, 2009. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
