- This is a combined synopsis/solicitation notice of intent for commercial items prepared in accordance with the format of FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are not being requested, and a written solicitation will not be issued for the solicitation number NOI9068 issued as a Notice of Intent. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC2005-31. This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is not a small business set-aside. The associated North American Industry Classification System (NAICS) Code is 325414, which has a size standard of 500. The National Institute of Allergy and Infectious Diseases (NIAID) intend to procure biological products on a sole source basis from BD Biosciences. The Vaccine Research Center (VRC) has been using the specific monoclonal antibodies from BD Pharmingen. They provide the essential element of the valuable intracellular flow assay, and they provide the same consistent high quality specific monoclonal antibodies. This consistency is essential for analysis data between the various protocols in HIV/AIDS, Influenza, and Ebola vaccines (protocol #’s Z01-Al-005002, Z01-Al-005003, Z01-Al-005004). Changing vendors would compromise the protocols and prevent proper interpretation of the results. The following factors shall be used to evaluate offers: 1) price, 2) capability to meet required specifications of product. The FOB point shall be Destination. This will be a firm-fixed price contract. The following Federal Acquisition Regulations provisions and clauses apply to the acquisition: FAR 52.212-1 Instructions to Offerors Commercial Items; Far 52.212-3 Offeror Representation and Certifications Commercial Items; Far 52.212-4 Contract Terms and Conditions Commercial Items; Far 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items; and FAR 52.406-7 Central Contractor Registration (2003).
