Description
TRIAL PREPARATION, PRESENTATION, AND TESTIMONY CURRICULUM: "3-day, 24 hour course for up to 40 law enforcement officers "Designed to equip officers with techniques to effectively present cases in court "Course must include a pre-test to evaluate level of experience of overall class experience, which may be a written pre-test for immediate grading, or electronic classroom response system for immediate feedback and evaluation "Course must include a systematic method for providing interaction, feedback to students, checks for learning, and evaluating effectiveness of instruction such as an electronic classroom response system or equivalent method of evaluation "Practical exercises must be incorporated in the instruction and must reinforce teaching points "Practical exercises must accurately simulate courtroom trial procedure and testimony, including trial preparation, direct examination, cross examination, and preparing and handling exhibits. "The following topics must be included in the course curriculum: oPreparing for trial during the investigation of the trial oWays to effectively manage an investigation to ensure success from arrest through conviction oEnsuring paperwork and details are complete prior to filing charges oPreparing exhibits creatively and effectively for trial oReviewing all evidence in the case including that collected or prepared by others oEvaluating how each part of the investigation fits into the whole prosecution oTrial preparation with the prosecutor assisting the prosecutor to do the job oOrganizing materials, notes, exhibits, and evidence prior to trial oDeveloping a resume for placing the witness at the beginning of testimony oDeveloping the legal issues of the trial, including elements of offense, the indictment, culpable mental states, and evidentiary issues oAddressing errors and adverse issues in a straight forward effective manner oPreparing your testimony as an expert witness oProviding direct testimony during the trial oEffectively handling exhibits and physical evidence oDealing with cross examination oEffectively dealing with defensive tactics during cross examination oAvoiding unnecessary objections during testimony oFollow up after trial assessing the positive aspects of trial and correcting the negative aspects of trial MATERIALS TO BE SUBMITTED: "Two (2) copies of all materials that will be used to conduct the class and that are provided to students must be submitted for review in soft or hard copy. This includes, but is not limited to: oAll PowerPoint files or slides shown to students oAll video or audio media files shown to the students oCourse outlines, lessons plans, course objectives, etc. In the case of multiple instructors, the instructor for each block of instruction must be identified oDaily schedule of topics covered, by block of instruction, hour by hour, etc. oCopies of all material provided to the student by the vendor: textbooks, workbooks, handouts, quizzes, tests, worksheets, scenarios, practical exercises, etc. "All materials submitted will be held in confidence by the Iowa National Guard and will only be used to evaluate the contract proposal. All materials submitted will become the property of and be retained by the Iowa National Guard. INSTRUCTOR(S): "The instructor(s) must have the following qualifications: oMinimum of two instructors for course oInstructors must be practicing or formerly-practicing prosecuting attorneys oInstructors must be currently engaged, or have relevant experience, in training civilian law enforcement officers in legal aspects of investigations, courtroom demeanor, testifying at trial, or similarly related topics oInstructors must have experience in prosecuting criminal cases, conducting jury and bench trials, and advising law enforcement investigators during investigations prior to prosecution oInstructors must have relevant experience in understanding/explaining criminal procedure including establishing elements of the offense, culpable mental states, trial procedure, and indictment oInstructors must have experience in presenting topics, checking for understanding, and conducting systematic checks for learning such as by use of electronic response systems or similar methods of instruction. "The instructors must provide the following information: oDates, locations, audience, name and phone number of the point of contact for previous iterations of this specific/ or similar courses instructed by the vendor oA resume or biography detailing the educational background, professional experience, and employment history of each instructor. DATES/LOCATIONS: 2 dates, iterations and locations to be determined during FY09 8 dates, iterations and locations to be determined during FY10, FY11, FY12, and FY13. MCTC covers the 54 States and its territories *Base year plus four option years: The base year will include two iterations and each option year will include eight class iterations with dates and locations to be determined. Course cost should be submitted for the courses to be held in the base year and separate prices for the courses to be held during each option year. Funding for the Base Years and Options years is subject to Congressional Approval availability of funds. EXPENSES: All travel, lodging and meal expenses are to be incurred by the instructor(s). All expenses related to printing and delivery of course materials are the responsibility of the contracting firm.
