- Description
- This is a combined synopsis/solicitation for commercial itemsprepared in accordance with the format in the Federal Acquisition Regulation (FAR), subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is DE-AC52-09NA29307 (Building TA-43-39 Remediation/Decommissioning) and is issued as a Request for Proposal (RFP). The solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-30. Availability of Funds: Funds are not presently available for this contract. The Governments obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. The National Nuclear Security Administration (NNSA) intends to award a Remediation Contract for Building TA-43-39 at the Los Alamos Site Office, Los Alamos, New Mexico. This contract will be awarded using a Lowest Price, Technically Acceptable (LPTA) source selection evaluation process in accordance with FAR Part 15. This solicitation will be issued as a Service-Disabled Veteran-Owned Small Business Set Aside with the applicable North American Industry Classification System (NAICS) Code of 562910; the Size Standard is $14,000,000, footnote 14(b) 500 employees. The statutory authority is 15 U.S.C. 657f, as implemented by the FAR, Subpart 19.14 entitled Service-Disabled Veteran-Owned Small Business Procurement Program. FAR Part 19.1405, Service-disabled veteran-owned small business set-aside procedures, (a) The contracting officer may set-aside acquisitions exceeding the micro-purchase threshold for competition restricted to service-disabled veteran-owned small business concerns when the requirements of paragraph ((b) see below) of this section can be satisfied. The contracting officer shall consider service-disabled veteran-owned small business sole source awards (see19.1406). (b) To set aside an acquisition for competition restricted to service-disabled veteran-owned small business concerns, the contracting officer must have a reasonable expectation that (1) Offers will be received from two or more service-disabled veteran-owned small business concerns; and (2) Award will be made at a fair market price. Description of Work: The Los Alamos Site Office (LASO) in conjunction with the Los Alamos National Laboratory (LANL) will decommission the Technical Area 43 building 39 LASO Building. All waste must be removed and disposed by the Contractor to appropriate treatment, storage, and disposal facilities approved by LASO. The areas occupied by the structures must be graded to the original contour. The Site Projects-Disposition group (SP-DISP) will provide field management assistance of Contractor activities for LASO. The Contractor shall provide all labor and material to include supplies, equipment, insurance, and incidentals for the disposition, demolition, and disposal services of the LANL TA-43-39 LASO building. The Contractor shall assess the hazards associated with the demolition of TA-43-39 to include facility demolition, asbestos, lead-based paint, residual diesel fuel in the tank and piping system, RCRA metals (including lead seals, lead-based paint, mercury from switches, and other areas of contamination as mentioned in the characterization documentation), and polychlorinated biphenyls (PCBS). Proposed Evaluation Process/FAR Clause at 52.212-2, Contract Terms and Conditions Commercial Items, applies to this acquisition: Proposals will be evaluated based on the Lowest Priced Technically Acceptable (LPTA) source selection procedures in accordance with FAR Subpart 15.101-2, LPTA Source Selection Process. The following factors shall be used to evaluate offers: Past Performance; Past Relevant Experience; Past and Reparative Experience with asbestos abatement, demolition, and working with LANL; Safety Records or EMR rates; the management structure of the contractor and what portions of work will be subcontracted and to whom; the technical approach for managing the project and coordinating all phases of the work including the transportation of waste to certified landfills; and Management Plan. All factors are equal in importance with price being the determining factor. Proposal factors will be evaluated against the criteria on a Go (acceptable)/No-Go (non-acceptable) basis. The factors identified as Go/No-Go have been chosen to screen out proposals that pose unacceptably high risk. Unacceptably high risk proposals are those which have not demonstrated the ability to perform satisfactorily on projects with similar requirements or meet other minimum standards established in the RFP. If applicable, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offers specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Proposals shall include a completed copy of the provisions at FAR 52.212-3, Offeror Representations and Certifications Commercial Items, with the proposal. Site Visit: A site visit is scheduled for 9 a.m. MST, April 14, 2009. All Offerors are to submit their interest in attending the site visit to John Gallegos; email address jagallegos@doeal.gov: Phone number 505-665-8439, by April 9, 2009. Accommodations need to be made for the site visit, to include your COMPANY NAME, NAMES OF THOSE ATTENDING, THEIR JOB TITLE, and verification of US Citizenship by April 9, 2009. In addition, a valid drivers license will be required to receive visitor badges. Interested parties will not be allowed to attend the site visit if the requested information is not received in time. Proposal Submission Date, Time, and Place: All proposals are due April 28, 2009 at 1630 (5 pm) MST. Submit the RFP to: Ed Williams via e-mail at ewilliams@doeal.gov. The response shall have no page limit and must contain the following: Response Cover Letter. At a minimum, provide the following information in the Response Cover Letter: Project Title: Remediation and Demolition: Building 39, LASO Building, Technical Area 43. Name, address, telephone and facsimile numbers of the contractor (and electronic address if available). DUNS, CAGE, and tax identification numbers. Names, titles, telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the Contractors behalf with the Government in connection with this solicitation. Name, title, and signature of person authorized to propose on this solicitation. Acknowledge that your companys data at the Central Contractor Registration website is current per FAR Clause 52.204-7, Central Contractor Registration. Note, that registration must be validated on an annual basis. Acknowledge receipt of amendments by number and date. Provide a statement specifying the extent of agreement with all terms, conditions, and provisions included in the agreement to furnish any or all items upon which prices are offered at the price set opposite each item as reflected on the proposal schedule. Failure to agree with all stated terms, conditions, and provisions may result in your proposal being rejected as non-responsive. Along with the proposal, the Contractor must submit a detailed breakdown of all Contractor and Subcontractor indirect and direct costs. Indirect costs should include field office overhead, home office overhead, G&A, labor burden, and profit. Indirect costs may be reflected as percentages. However, if the Government feels that indirect cost percentages are above what is considered normal, the Contractor will be required to submit documentation to support the percentages Direct costs shall include equipment, tools, supplies, materials, and labor. Equipment and tool costs should include a description of each piece of equipment used, number of hours used, and hourly rate. Supply and material costs should include a description of supplies and materials used, quantities, and unit price. Labor costs shall include labor description, number of hours, and hourly rate. Additional Information: The Clauses at 52.212-4, Contract Terms and Conditions Commercial Items and 52.212-5, Contract Terms and Conditions Required to Implement Statues Or Executive Orders Commercial Items, apply to this acquisition. Any additional contract requirements can be found in the attached Statement of Work. Invoicing and payment methods will be provided to the awardee and on the award document. The solicitation will be available by Internet access only. Hard copies, CDs, DVDs and/or any other media will not be available or provided. All solicitation documents and amendments will be posted to IPPS DOE and www.fbo.gov. Questions regarding the solicitation shall not be accepted via telephone or fax. Prospective offerors should check the website frequently for changes to the solicitation and posting of amendments. It is the responsibility of the contractor to respond by the due date and time, and to verify successful receipt of their proposal. Prior to submitting a proposal, prospective offerors must be actively registered in the Central Contractor Registration (CCR) system. The CCR web page address is www.ccr.gov.
