- The purpose of this announcement is to 1) provide a status update on the Missile Defense Agency Engineering and Support Services (MiDAESS) acquisition, and 2) provide a proposed RFP Section H clause for Limitations on Subcontracting (applicable to RFP HQ0147-09-R-0001). The government is preparing responses to numerous questions submitted after release of the draft RFPs and subsequent Industry Days in February 2009. Responses are projected for release during April 2009. The government is processing approximately 170 letters resulting from the formal Organizational Conflicts of Interest (OCI) meetings. The Agency has released 50 letters and others will be released during the next few weeks, as industry partners submit their additional data to complete the reviews. It is anticipated the MDA will complete all OCI assessments and release the letters during April 2009. The final RFPs are projected to be released during May 2009. As a result of numerous questions relative to the small business set aside draft RFP (HQ0147-09-R-0001) and the application of Limitations on Subcontracting (referred to as the 50% rule), the clause below will be included in Section H of the RFP and resultant contracts. This clause is provided for your information. ********************************************************** H-__ Compliance with FAR 52.219-14, Limitations on Subcontracting (referred to as the “50% rule”). a. The period of time used to determine compliance with FAR 52.219-14, Limitations on Subcontracting, will be the base contract period, including all task orders issued under the contract. Small business contractors do not have to comply with the “50% rule” on each task order. b. In accordance with 13 CFR Section 125.6(i), if the contractor is a joint venture and meets the following requirements, compliance with the “50% rule” will apply to the cooperative effort of the joint venture, not its individual members: 1. The joint venture contractor is exempt from affiliation under 13 CFR Section 121.103(h)(3); and, 2. The joint venture contractor qualifies as a small business concern. c. Pursuant to 13 CFR Section 121.103(h), a joint venture may or may not be in the form of a separate legal entity.
