- VA Medical CenterIndianapolis, Indiana JUSTIFICATION AND APPROVAL TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION Based on the following justification, the use of other than full and open competition for the proposed contractual action is hereby approved pursuant to authority of 41 U.S.C. 253(C)(1) under FAR 6.302-2 Justification 1.Identification of Agency and Contracting Activity Dept of Veterans Affairs Medical Center, Richard L Roudebush VA Medical Center, 1481 W Tenth Street, Indianapolis, IN 46202 2.Nature/Description of ActionThis document sets forth the justification and acceptance approval for one of the exceptions to full and open competition allowed under Federal Acquisition Regulation Part 6.302-2 Unusual and Compelling Urgency. 3.Description of Supplies/ServicesProvide DME/HME services for the VA Indianapolis, IN including DME/HME pick-up/delivery, set-up and patient education. 4.Identification of Statutory Authority The statutory authority permitting other than full and open competition is 41 U.S.C. 253(C)(2). 5.Demonstration of Contractors Unique QualificationsFor VA Indianapolis, IN to maintain Joint Commission (JC) accreditation the provider of the DME/HME services must meet or exceed JC standards and since the original contractor filed bankruptcy the VA is in immediate need for a vendor to provide these services. Because of this emergent need the VA does not have time to review vendors' qualifications to determine if they meet JC standards unless they are already accredited and can provide their current Certificate of Accreditation. 6.Description of Efforts Made to Ensure a Variety of Potential SourcesLocal sources were contacted to determine if they were JC accredited and interested in providing this service on a short term. The only source located was RoTech Health Care. 7.Determination of Fair and Reasonable Cost The Contracting Officer will make a determination of fair and reasonable cost prior to executing this procurement. 8.Description of Market Survey: Local and area HME vendors were contacted including Home Health Depot, Indianapolis; Benchmark Mobility, Indianapolis; Access Mobility, Indianapolis; Bulldog Mobility, Brownsburg; and Quality Wheelchair Repair, Lafayette, however, none of these vendors are JC accredited. 9.Any Other Supporting Data: None 10.Listing of Interested Sources: RoTech Healthcare Inc, 2600 Technology Dr, Suite 300, Orlando, FL 32804, 407-822-4600 (main office) 11.Actions That May be Taken to Overcome Barriers to Competition.
