- RECOVERY -Boiler Plant Deficiencies Project #562-09-505Estimated Construction Cost Range: 250,000.00 - 500,000.00 Pursuant to 38 U S C 8127 ( c ) of Public Law 109-461 and the provisionsof Department of Veterans Affairs Office of Acquisition and MaterialManagement (O&MM) Information Letter 049-07-08, the VA Medical Center,Erie, PA intends to award a service disabled veteran owned sole sourcecontract for Project #562-09-505, Boiler Plant Deficiencies Project.This project, which was initially requested to be funded as an emergencyNRM (non-recurring maintenance), addresses the correction of specificdeficiencies that were identified in a VISN-wide Boiler Plant inspectionaudit. Delay in the award of this contract could result in failedoperational performance which could ultimately result in a boiler plantshut-down which will adversely affect the entire medical center andcould result in closure of facility based on the boiler safetydeficiencies noted during the inspection. It is imperative that work onthis project commence prior to the start of the cooling season. As a result of market research, John B Henry & Associates, 1044 NProvidence Road, Media, PA 19063, a service disabled veteran owned smallbusiness, was recommended as having recent successful boiler plantexperience within VISN 4. Contact was made with the company and it wasdetermined that the company was qualified and could meet the timelineidentified by the government. As such, a proposal was requested andreceived on March 3, 2009. Subsequent to receipt of proposal, theproject was converted from emergency NRM funded to a Recovery Actfunded. In accordance with IL 001AL-09-07 dated March 17, 2009, competitiveprocedures shall be used whenever possible. However, based on theconditions stated herein and in accordance with PL 109-461, theContracting Officer has determined that continuation of this procurementstrategy is in the best interest of the Government and that the cost tothe Government is fair and reasonable.
