- FEDBIZOPPS.GOV ANNOUNCEMENT: PRESOLICITATION NOTICE ACTION CODE: CLASSIFICATION CODE: J – Maintenance, Repair and Rebuilding Equipment SUBJECT: Service Contract for the Time of Flight Secondary Ion Mass Spectrometry IV Instrument SOLICITATION NUMBER: NB837050-9-02988 RESPONSE DATE: May 05, 2009 CONTACT POINTS: Monique Speights, Purchasing Agent (301) 975-8855; Todd Hill, Contracting Officer (301) 975-8802 DESCRIPTION: The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with ION-TOF USA, Inc., of Chestnut Ridge, NY for the purchase of a service contract the Time of Flight Secondary Ion Mass Spectrometry IV Instrument under other than full and open competition by the authority of FAR subpart 13.106-(b): Only one responsible source and no other services will satisfy agency requirements. Sole Source determination is based on the following: NIST currently uses an ION-TOF USA, Inc. Time of Flight Secondary Ion Mass Spectrometry IV Instrument. NIST requires a yearly maintenance agreement for the spectrometry IV instrument. ION-TOF USA, Inc.’s maintenance agreement utilizes proprietary procedures and parts. Therefore the service agreement must be supplied by ION-TOF USA, Inc. The service agreement will include annual preventative maintenance and emergency repairs, including part replacement if necessary. ION-TUF USA, Inc. is the sole manufacturer and distributor of the microscope for which the service agreement is required to satisfy the Government’s minimum requirements. The period of performance for the service contract, shall be 1 year from the date of award. The North American Industry Classification System (NAICS) code for this acquisition is 334516. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 1:00 p.m. (EST) on May 05, 2009. Inquiries will only be accepted via email to monique.speights@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
