Justification for Other than Full and Open Competition FedBizOpps: Pre-Solicitation Notice - Posted 4/24/2009 Solicitation No. AB133R-09-RP-0060 NAICS: 334519; 500 employees This publication serves as a notice of intent to procure, on a sole-source basis, with Battelle Memorial Institute. The intended acquisition concerns the acquisition of eight each "Autonomous Partial Pressure Carbon Dioxide Monitoring Systems (pCO2)" for which the Government intends to acquire from one source under the authority of 41 USC 235(c) (1), Only One Responsible Source. NOAA's Oceanic and Atmospheric Research (OAR), Pacific Marine Environmental Lab (PMEL) requires the manufacture of the pCO2's. The proposed contract will be a one-time, firm-fixed price, procurement, for a newly commercialized item. Commercial procurement procedures apply. The only known source to provide the required pCO2 is Battelle Memorial Institute. Battelle Memorial Institute has developed proprietary products and techniques that comply with PMEL's current proprietary equipment needs. The pCO2's will be paired with proprietary equipment that was originally designed/procured from Battelle. Additionally, Battelle Memorial Institute manufactures the Battelle systems are calibrated with gas standards that are traceable to World Meteorological Organization (WMO) standards. This is a strict requirement for all NOAA CO2 observing systems so that our measurements can be referenced back to the global observing network. There are no other systems available commercially that can be calibrated with these standard gases. Furthermore, said systems are part of an ongoing network of autonomous systems. These systems have to be swapped out once per year to maintain a continuous measurement record. The new systems, therefore, must have the same dimensions and design specifications to work in the platforms that are already deployed in the Pacific and Atlantic Oceans. All interested parties must respond to this announcement by May 11,2009. Responses must include the contractor's name, contact information, and information indicating the contractor's capability to provide the required pCO2 monitors. Documentation shall be submitted to support the contractor's capability to provide the monitors that will work with PMEL's system currently in use, along with applicable contract numbers, points of contact and phone numbers, and a full description and specifications provided under previous contracts for the same purposes. Any response that does not include this information will not be considered. The Government will evaluate each response to determine if the contractor has the experience, knowledge and capability to provide the proprietary specifications. No solicitation is available at this time. All contractors doing business with this Acquisition Office must be registered with the Central Contractor Registry (CCR). No award can be made unless the vendor is registered in CCR. For additional information and to register in CCR please access the following web site: http://www.ccr.gov/. In addition, completion of the online representation and certifications application (ORCA) is required. The applicable NAICS is 334519 with a small business size standard of 500 employees.
