- The National Institute of Standards and Technology (NIST), intends to negotiate, on a sole source basis, under authority of 41 U.S.C. 253(c)(1), with Denton Vacuum, LLC, Moorestown, New Jersey, for an upgrade of a Denton Vacuum Infinity 22 Thermal Evaporator to an Infinity 22 Electron-Beam Evaporator NIST cites FAR 6.302-1(a)(ii)(A) (see excerpt below) as primary rationale for Sole Source Determination. (ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in – (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition. Sole Source determination is based on the following: NIST CNST NanoFab currently uses an existing Denton Vacuum Infinity 22 Electron-Beam Evaporator. The NIST CNST NanoFab has a need to increase its electron beam deposition capability. Electron beam deposition is a commonly used means of applying thin films (metals and other materials) onto nearly all the nanostructures developed by NIST CNST researchers. The NIST CNST NanoFab has a need for a second Electron-Beam Evaporator. NIST CNST NanoFab has an existing Denton Vacuum Infinity 22 Thermal Evaporator. Therefore, NIST CNST will convert the Denton Thermal Evaporator to an Electron-Beam Evaporator. The intent of this procurement is to exactly duplicate an existing tool in the CNST NanoFab with the specification that all the processes developed on one tool can be seamlessly transferred to the other. In order to ensure that requirement, all components, hardware and software, have to be exactly identical on both tools once the upgrade is completed. The electron-beam evaporator relies on software proprietary to Denton Vacuum to provide the necessary communication between the electronic controllers and the actuators (electron gun, power supplies, crystal monitor, sweep units, pumps, interlocks, valves, shutters, etc.). As a result, Denton Vacuum, LLC, is uniquely qualified to satisfy the Government’s minimum requirements. The North American Industry Classification System (NAICS) code for this acquisition is 333994, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by May 8, 2009, 3:30 p.m. EST. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
