Description
NASA/ARC has a requirement to extend the performance period of the ARC ProtectiveServices Contract for an additional ten months; said extension will consist of a onethree (3) month performance period and seven (7) one-month option periods, the exerciseof which will be determined by the Government on a monthly basis. A modificationreflecting this extension will be issued on May 31, 2009, being the expiration date ofthe current protective services contract. NASA/ARC intends to extend the period of performance of contract NNA04CI14T, which wasawarded as a result of full and open competition under a GSA Schedule to SecTek, Inc., onJune 1, 2004. This extension is required due to a Protest filed on September 17, 2008, inthe United States Court of Federal Claims challenging NASAs agency-wide contractawarded on May 20, 2008 for protection services (i.e.,security guard services potential fire/fighting/prevention services, and potential emergency medical responseservices) to be provided at NASA/ARC and thirteen different locations located across theUnited States. Authorization of this extension has been issued by NASA Headquartersunder PIC-04, which provides a class deviation from the requirements of FAR 17.204(e) andNFS 1817.204(e)(iii), which limit the terms of service contracts to five (5) years,including the basic contract and all options. This class deviation applies only toexisting contracts containing requirements that will ultimately be provided under the NASA Protective Services Contract (NPSC) when the NSPC protest is resolved. The NSPC isexpected to be available for use in the near future. NASA is using the authority for Other Than Full and Open Competition provided by 10U.S.C. 2304(c)(1). Because SecTek possesses unique expertise in meeting the securityrequirements of the Center, no alternate source could adequately provide for themaintenance of the Centers comprehensive security program during this brief period ofextension. Award to another source when the agency-wide contract for protectiveservices has been recently awarded, and while the resolution of the protest is nearingcompletion, would result in a substantial duplication of cost to the Government that isnot expected to be recovered through competition as well as unacceptable delays infulfilling the agency's requirement. The Government does not intend to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform theeffort in writing to the identified point of contact not later than 4:30 p.m. local timeon May 14, 2009. Such capabilities/qualifications will be evaluated solely for thepurpose of determining whether or not to conduct this procurement on a competitive basis.A determination by the Government not to compete this proposed effort on a full and opencompetition basis, based upon responses to this notice, is solely within the discretionof the government. Oral communications are not acceptable in response to this notice. All questions MUST bein writing and should be directed to Ms. Drake not later than 4:30 p.m. local time on May14, 2009.
